https://saraacarter.com/flynn-files-emergency-petition-with-u-s-court-of-appeals-to-replace-judge-and-dismiss-case/

Quote:

"Petitioner respectfully requests that this Court order the district court immediately to (1) grant the Justice Department's Motion to Dismiss; (2) vacate its order appointing amicus curiae; and (3) reassign the case to another district judge as to any further proceedings," Powell stated in the petition, which was obtained by SaraACarter.com.

She asked the court to determine whether "the district court exceeded its authority and egregiously abused its discretion by failing to grant the Government's Motion to Dismiss the Criminal Information and, instead, appointing an amicus to oppose the motion and to propose contempt and perjury charges against General Flynn, while inviting additional amici."

No copy yet, but Sara Carter has seen it.

The redacted paragraph definitely has material about Flynn it in. We know that from a letter Rice's attorney wrote.

Tracy Beanz has compiled rather convincing evidence that there was an unannounced criminal in investigation of Flynn in addition to the counterintelligence investigation via Crossfire Hurricane. Read in the threadreader so you can readily view the reference materials.

Again I ask, why was Flynn the holy grail in this crusade against Trump? They were determined to "get him". Even now when they have clearly failed, they are grasping at every straw to still "get him".

Why?

Because Flynn knows where all of the bodies are buried.

LOL! Beat by less than a minute.
"If you will not fight for right when you can easily win without blood shed; if you will not fight when your victory is sure and not too costly; you may come to the moment when you will have to fight with all the odds against you and only a precarious chance of survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves." - Sir Winston Churchill

Read his book. It goes way back to before Obama fired him, to when he was in Afghan and presented non-politically correct analyses about our intell. apparatus there; his main gripe was his focus on the Islamic state, and islam as a political ideology, not a religion, and also that Iran was a real terrorist state.

He was outspoken about it afterward as well. His book (and perhaps more importantly his ideas) are sort of the antithesis of Obama's muslim diplomacy via pallets of US dollars;

Also, the exoneration of Flynn completely destroys the credibility of the Mueller Investigation, and consequently the entire Russian collusion narrative goes down the drain.

From Powell's writ application

"The district judge's latest actions failing to grant the Government's Motion to Dismiss, appointing a biased and highly-political amicus who has expressed hostility and disdain towards the Justice Department's decision to dismiss the prosecution, and the promise to set a briefing schedule for widespread amicus participation in further proceedingsbespeaks a judge who is not only biased against Petitioner, but also revels in the notoriety he has created by failing to take the simple step of granting a motion he has no authority to deny. This is an umpire who has decided to steal public attention from the players and focus it on himself. He wants to pitch, bat, run bases, and play shortstop. In truth, he is way out in left field."

It is simply infuriating how they treated this man.

Quote:

First, Petitioner, through no fault of his own, has been drawn into a Kafkaesque nightmare that is a cross between The Trial and In the Penal Colony. He has been subjected to deception, abuse, penury, obloquy, and humiliation. Having risked his life in service to his country, he has found himself the target of a political vendetta designed to strip him of his honor and savings, and to deprive the President of his advice. He has been dragged through the mud and forced, through coercion and the artful withholding of information crucial to his defense, to confess to a crime he did not commit indeed, to a crime that could not exist.

Having at last, through the relentless determination of his current counsel, brought the truth to light, he now learns that the judge who is charged with adjudicating his case impartially has, in Judge Posner's words, decided to "play[] ... U.S. Attorney." The 30 equities demand an end to this nightmare and restoration of General Flynn's freedom and peace of mind.
Quote:

Unlike in Fokker, the district judge's outrage at General Flynn does reveal a deep-seated antagonism. In open court, knowing full well that his words would be broadcast all over the world within minutes, the district judge accused General Flynn of treasona charge hurtful to any American, but a stake through the heart of one who has risked his life protecting the United States from its foreign enemies. The judge also expressed his personal "disgust" (pointing out he was not hiding it) and accused him of arguably having "sold out" his country. App. 1: 34. Even uttered in a private conversation, such words would be cause for recusal, but to say them to the 34 world does, indeed, evince "deep-seated ... antagonism that would make fair judgment impossible." Liteky, 510 U.S. at 555.

f the Court grants the principal relief Petitioner seeks, there may not be much by way of further proceedings in the case, but there could be. Petitioner, the Government, and the appearance of justice will best be served by having another judgeone who has not implied that Petitioner is a traitorconduct any further proceedings in the case.

Unredacted paragraph. Doesn't seem like much... Why would this be redacted?
Quote:

"Director Comey affirmed that he is proceeding "by the book" as it relates to law enforcement. From a national security perspective, Comey said he does have some concerns that incoming NSA Flynn is speaking frequently with Russian Ambassador Kislyak. Come said that could be an issue as it relates to sharing sensitive information. President Obama asked if Comey was saying that the NSC should not pass sensitive information related to Russia to Flynn. Comey replied "potentially". He added that he has no indication thus far the Flynn has passed classified information to Kislyak, but he noted that "the level of communication is unusual."

Dr, or Hawg; is it possible that the goal here is to get a side deal? Something like Sullivan wont give up on Flynn, and the idea is to beat him over the head over and over until Flynn says "eff it I'm out." With the idea of throwing in a deal like, this all goes away, but you can never come back in a civil case against us?

The idea being that they know the prosecution was so dirty, and the judge screwed up enough, that they want it to never see the light of day again and save face with their lib friends?

Forgive me if this is a dumb question, and not possible. Just trying to figure out why this is so far off the rails and out of the norm.

Again, thank you to everyone that has put so much time into this thread and for your continued patience explaining everything to us.

A side deal? The answer to that is not only no but hell no. Not only unethical, it's illegal as hell to even propose such a thing. Asking Flynn to forego a civil claim for damages in exchange for dismissal of criminal charges when done by a prosecutor is anathema. When done by a judge it is a non-starter.

HTH.

And there's really no such thing as a dumb question, particularly in a complicated legal proceeding, sweetie.

I believe the part they wanted hidden was this,

"He added that he has no indication thus far the Flynn has passed classified information to Kislyak"

This statement shows they had no predicate for speaking to Flynn. This alone could have been exculpatory evidence Flynn could have used in his defense.

The people who are redacting should be charged with obstruction.

Remember my questions about the awkward procedure here? Sullivan can, in theory, file his own response. Or he can maybe deputize Gleeson to do it on his behalf, I suppose. It's a mess.

The cleanest way would have been to have DOJ join in on the petition for a writ of mandamus with Flynn's counsel. And that may still happen, I suppose.
