But in terms of leaking the Flynn/Kislyak call to the press, DOJ doesn't seem inclined to enforce those laws since James Wolfe was caught red handed with leaking an even higher classified document, a FISA application and he got off.
I think that was because of pressure from the Senate Intelligence Committee not to prosecute. Of course, several on that committee need to be prosecuted for their actions, too.

Let's not forget that Nunes and co. (when republicans still controlled the House) essentially quit communicating with the SSCI because they weren't trustworthy. Some of that was obviously because of Wolfe and his leaking, but Warner, Burr, and others were not acting in good faith. They should all be prosecuted.

Flynn did not know he was "sitting down with the FBI." He really just thought it was a courtesy visit, more or less.

Except Strzok and Page wanted to move on Flynn while McCabe was Acting Director, IIRC. Only reason they didn't was because Mueller was already coming on board as Special Prosecutor.

On Wolfe, one has to wonder. He struck a plea deal after his lawyers notified every SSCI senator they may be called to testify in his criminal trial. House of cards.
Could you explain further? Are you
saying there could be criminal referrals against SSCI senators being considered? Or the SSCI senators were being protected by corrupt DOJ personnel?
Pardon my ignorance.
I think it was the threat of them being called as witnesses in a trial...which, obviously, COULD besmirch their Senate "careers", but if divulged facts/evidence can implicate them, it's even more of a mess because then the ugly heads Impeachment pop up like whack-a-mole.

Not for WARNER obviously, he of the pristine Democrat heritage, but for Burr and 7 other Republicans...

For some of them, but Wolfe was THEIR GUY. Seems they were all chummy, dims and republicans, and they circled the wagons for Wolfe. I don't think it was just about saving themselves.

And that they released their ridiculous Russia report last week speaks to them not being really interested in justice and truth.

I think it's absolutely about saving themselves. They likely have enough on each other than if any of the others go down, that person burns the rest. M.A.D.

Warner was actively involved in the conspiracy against Trump. At the very least, others on the committee were aware of that.

Maybe, but to say the least Wolfe wasn't using his right head when he leaked it to his young side piece reporter ***** from the SCIF.

Not really...

First, Trump / Barr would have to fire Wray and, usually promotion for Temp Director would come from within...most likely David Bowdich...

Then again, if Barr turns the evil eye of Sauron onto Wray, those below him may scatter like a covey of Quail...

Sol Wisenberg, former Deputy Whitewater Independent Counsel, cited Garrity as a precedent that provides that any federal employee be notified of the purpose of any questioning by authorities. Clearly, the FBI did not notify Flynn.

Quote:

In United States law, the Garrity warning is an advisement of rights usually administered by federal, state, or local investigators to their employees who may be the subject of an internal investigation. The Garrity warning advises subjects of their criminal and administrative liability for any statements they may make, but also advises subjects of their right to remain silent on any issues that tend to implicate them in a crime.

I would have to read that case, but just from that summary: Since when is Flynn and employee of the FBI subject to an internal investigation?

Now that stuff is finally happening on this front again we almost need a daily or weekly "in review" post detailing the high points.

It will be interesting when all this finally wraps up to go back and reread this historic thread.

It is very encouraging news at just the right time. A shot in the arm after what has been a bleak couple of months on just about every front. I had honestly given up that nothing would ever come of it but it looks like maybe justice will finally be done. I pray they don't let up until they've climbed all the way to the top of the tree and cut out all the bad branches.

Do we know the actual verbiage of Flynn's supposed lie? Is there a transcript of his interview with the FBI? My understanding was that the agents that interviewed him thought - at the time - that while Flynn might have answered inaccurately, they thought he was trying to be truthful.

Per the FD-302 report summarizing the FBI's interview,
Quote:

The interviewing agents asked FLYNN if he recalled any conversation with KISLYAK in which the expulsions were discussed, where FLYNN might have encouraged KISLYAK not to escalate the situation, to keep the Russian response reciprocal, or not to engage in a "tit-for-tat." FLYNN responded, "Not really. I don't remember. It wasn't, 'Don't do anything.'"

Just think how long Durham has known a lot of what we are just now finding out and he likely knows much more. Reportedly he's been spending a lot of time in DC in SCIFs for the last several weeks. He's seeing the unredacted stuff and getting the fuller picture.

I wouldn't be surprised if some indictments are announced within the next few weeks.
