The legislature is precisely who I have a problem with (also the prosecutor). That's what I meant that it's ridiculous that anything is on the table. They're who initially put it there.
And again, I don't know why the fact that there are a range of punishments matters when literally any punishment from the government is ridiculous and probably unconstitutional for this. If the possible punishment were a stern letter from the mayor I'd still say that was too much.
