I disagree. Yes, his performance was over the top. But have you ever seen the real Jordan Belfort give a speech? He's over the top in real life.

It still doesn't change my opinion on the performance. I don't think it's one of his best. I do agree he should had won with The Aviator, though Foxx was great as well. He also should have been nominated in Titanic. He was by far the best character in that movie (except for the dude that got creamed by the ship's propeller).
