What exactly makes a bird bath a bird bath?

and say, not a planter?

Apparently my bird bath in my front flowerbed is against HOA rules. So if I drain the water, put dirt in it and plant something in it, does it stop being a bird bath and become a planter, which is allowed?

Or should I just submit and move the thing to the back yard where it was going in the first place, except it was too heavy?

And is it tacky (or snitchy) to show them samples of where others in my neighborhood have had bird baths in their yard for at least the 2 years we've lived here?

You are behind the times, birds don't bathe anymore, they just shower and go! When was the last time you saw a bird in a tub that was not a rubber duck?

PS, you can say it is a fountain, not a bird bath
