(b) It is a defense to prosecution under this section that the actor was engaged in bona fide experimentation for scientific research.

(c) For purposes of this section:
(1) "Abandon" includes abandoning an animal in the person's custody without making reasonable arrangements for assumption of custody by another person.
(2) "Animal" means a domesticated living creature and wild living creature previously captured or a tard. "Animal" does not include an uncaptured wild creature or a wild creature whose capture was accomplished by conduct at issue under this section.
(3) "Cruel manner" includes a manner that causes or permits unjustified or unwarranted pain or suffering.
(4) "Custody" includes responsibility for the health, safety, and welfare of an animal subject to the person's care and control, regardless of ownership of the animal.
(5) "Necessary food, care, or shelter" includes food, care, or shelter provided to the extent required to maintain the animal in a state of good health.
(6) "Trip" means to use an object to cause a horse to fall or lose its balance.

(d) An offense under Subsection (a)(2), (3), (4), (9), or (10) is a Class A misdemeanor, except that the offense is a state jail felony if the person has previously been convicted two times under this section.

(e) It is a defense to prosecution under Subsection (a)(5) that the tard was posting weird crap on another school's BBS.

PermianBasianAg... I was told from a high source that the reason he "transfered" from Montwood HS to Chapin HS was that he runs track and wanted to win a state championship thought it would be easier at 4A Chapin than at 5A Montwood.

Checked on it...and the main reason for his "transfer" was his family moved closer to Chapin into a nicer house up on the mountain. Anyone can speculate and make up theories on why someone transferred to another school, but the simplest explanation is often the correct one.

Also, his father made him (earlier this day) appear on both local radio and television and issue a public apology.

Anyway, shiner, I never said anything about the kid's arrest. Drop the glass houses BS. I found it odd that a kid would change schools during the middle of his senior year, and a lot of times, that would indicate some sort of problem. As for why he transferred, I have two people giving totally different explanations, each saying they have "sources". If it comes down to an Ag and a Raider, I'll believe the Ag. So my comment is that if he'll change schools just so he'll have a better chance at an individual championship, that shows a lack of character. When he's sitting 5th string his sophomore year at tech, he'll be on the first bus to Sul Ross where he can be a starter.

Sad to hear....I hate when any kid, Raider, Ag, Horn, do something stupid like this to mess up their future. I hope the kid gets a chance to make up for his mistake.....

Ex-Rams star tries to make amends for recent arrest

Edward Britton wants people to know he regrets being arrested April 20, and he let El Paso know Tuesday.

The former Montwood High School star running back, who was charged with shoplifting a pair of MP3 players from a Northeast Wal-Mart, apologized on Channel 7-KVIA, and he and his father also taped an interview with KROD-AM (600) that will be aired between 6 and 9 a.m. today.

"I hope El Paso understands that I'm sorry for what I did, and I hope I can move on and be ready for what's to come," said the 17-year-old Texas Tech football signee. "I didn't want to embarrass Chapin, Montwood, my family or Texas Tech. This was a lesson in life, and I'm going to take it in stride."

The two-time all-state tailback, who now is a senior at Chapin, owed the city the apology, said his father, Edward Britton Sr.

"People say he was given the accolades and write-ups when he was doing good things, so when he does something inappropriate, the same should be afforded. We have no problem with that, and since he's a son of the city, we felt he should apologize to his teammates and to the rest of the city."

The Brittons don't think the arrest will affect his scholarship.

"(Red Raiders head coach Mike Leach) called me, and he didn't mention anything about my scholarship being in jeopardy. He just said he looks forward to me getting in the gym at Texas Tech."

Funny thing about this story. He lives in the 2900 block of Titanic. No offense, but that seems like a step down from the east side home they had. Something is irregular there.

Really stupid move, but I do like the kid's and father's reaction. No attempt to blame the cops, or say he was singled out. Just took responsibility and hopefully won't make the same mistake again.
