Are you a first year retard? Did your mean civ pro teacher make you memorize the rules? For kicks: TRCP 97: A defendant must counterclaim claims rising out of the same transaction or occurence. There are exceptions for certain issues like joinder troubles. Res judicata may apply; it does not apply to permissive.

Since when did becoming a fire safety inspector require an advanced degree... or any degree at all, for that matter?

What do you practice and where?

Thinking up objective questions is really tough. I take back everything I said about professors and preparing tests in law school.

How about this: I hit someone with my car because I'm a such a stupid Aggie and I was trying to build a monument to Coach Fran on the floorboard of my car. They are a bloody mess. I get out of the car and tell the person laying on the pavement "Look, I'll give you $5000 bucks not to sue me for building a monument to coach Fran while driving."

Can the statement "I was building a monument to Coach Fran while driving" be admitted against me? Why or why not?

(And before you laugh, someone else try coming up with questions that have absolutely right and wrong answers and are reasonably short).
