This is just not true in the private sector in Texas.

Please try to keep up.

"A person who has authority over another in the scope of employment who retaliates
against that person in their voting by subjecting or threatening a loss or reduction of wages
or other benefit of employment because the employee voted for or against a candidate or
measure or refused to reveal how he or she voted commits a third degree felony offense.
Harming or threatening to harm a voter by an unlawful act in retaliation against a voter is a
third degree felony offense (Tex ElecCodeAnn, Sec. 276.001).

actually you dumb phauck. these were two differing points. derm said he had to let someone go. he also said that his long time physician was retiring and would probably end up being replaced by a foreigner. damn you are dumb, son.

Point me to any case law that shows an employee in the private sector winning a case due to termination based upon political affiliation.

i just fired someone because they voted for Obama. well, it wasn't "fired" as much as sending home our maid after she cleaned the kitchen, mopped the floor, polished the knob and made me a sammich. is that a felony?

I'm even trying to help you out and find one just out of pure curiosity but it seems like the only ones that even make it to a court of appeals are public employees.

Title VII seems to be working against you as well.

Um, I think that law has to do with allowing a voter "Time Off" to be able to vote. It really doesn't have much to do with retaliating against an employee for how they voted.

quote:
In Texas, Chapter 276 of the Texas Election Code governs an employer’s responsibility. Specifically, an employee is allowed reasonable time off to vote if polls are not open two consecutive hours outside the employee’s regular shift; and, this time off is paid. State agency employees are entitled to “sufficient” time off to vote.

With respect to penalties for failing to comply – our state statutes are clear:

* Employers who violate the time off to vote provision, by refusing time off where qualified or by penalizing the employee for visiting the polls on election day to vote, commit a Class C misdemeanor offense. TEX ELEC CODE ANN. § 276.004.

* A person who has authority over another in the scope of employment who retaliates against that person in their voting by subjecting or threatening a loss or reduction of wages or other benefit of employment because the employee voted for or against a candidate or measure or refused to reveal how he or she voted commits a third degree felony offense. Harming or threatening to harm a voter by an unlawful act in retaliation against a voter is a third degree felony offense. TEX ELEC CODE ANN. § 276.001.

* In addition, employers who violate the “take time off to vote law” commit a Class C misdemeanor offense and are subject to a fine of up to $500. TEX PENAL CODE ANN. § 12.23. Employers who retaliate against voters because of how they voted or for refusing to disclose how they voted commit a third degree felony offense and are subject to a fine of up to $10,000 and imprisonment of 2 to 10 years. TEX PENAL CODE ANN. § 12.34.

My suggestion to the person who got laid off by this azzhole.
Sue him for sexual harassment. Even if you are both guys, sue him anyway. He is a jerk who deserves it. His insurance company will want to pay you off instead of going to court. Now you are in the drivers seat, take the money or watch him squirm on the stand, your choice

And herein lies how effed up the mind of a loser liberal is. They are SUCH standup people with principles, yet the moment they are upset their response goes so far beyond the deep-end that they will throw any ounce of integrity or character out the window to prove a point.

true story: i was in washington about 4 years ago and saw a group of 10 college students protesting the war by duct taping their mouths while standing in front of the supreme court. i don't think their protest made much of a difference. the next time i was there i saw two hairy middle-aged women protesting the war with megaphones. one of them got right in my face, so i yelled back 'get out of my face you hairy liberal c-word,' with serious aggression. she stepped aside

oh i forgot the moral of the story: these same liberal types now don't protest the war anymore. you wanna know why? because a democrat is in office. they never protested the war to begin with, they only protested that a republican was the president. they actually could have cared less that a war was happening overseas

For the last time, Dermdoc did not do that. If that was the case, why did he wait a year and a half after the guy voted for Obama to fire him?

He was simply pointing out the irony in that the employee voted for someone who is indirectly responsible for him losing his job.

It is irrelevant to the issue of whether the felony was committed by Doc.

It is legal to go see a foreign doctor.

It is illegal to fire someone because of how they voted. It's the "consequences" of voting a certain way, and the "because I can" comments that are going to be a real problem for Doc.

Wow...so this idiot has been going on and on arguing about how dermdoc is going to get sued and charged with a third degree felony the whole thread. And now suddenly he backtracks and says it's irrelevant whether doc actually committed a crime?

And it's painfully obvious this choad that's arguing till he's blue in the face either lacks basic reading comprehension, or didn't even see dermdoc's posts in the first place.

I'm sorry - isn't Texas an employment at will state? You can be fired for any reason, or no reason at all. Someone probably already mentioned that but I'm too lazy to read all the posts.

It is, but there are limits on the reasons. You can't discriminate against someone for race for example. Whatever your reason, it's probably best to avoid all the problems by not publically divulging the reason or even insinuating what the reason could have been.
