It literally says "or" between the 2 bullet points for the requirements.

Not sure how to bold the "or" on mobile but it's in there. Unless I misunderstood you?

Push would be a few days. Friday to Tuesday. I agree this would be preferred but sellers being difficult.

I can promise there is not a CO law REQURING the lender to accept a POA in your situation. Do you have any idea if the seller is trying to close on a house the same day?

I'm assuming they aren't because we have over a month long PCOA.

I guess me thinking the lender would have to accept a POA is if they are also obligated at this point to allow us to close. If they could pull out between now and then unilaterally then yeah POA or not means nothing. But otherwise I'm pretty sure they do have to recognize it the same way they would if both of us were present.

I'm not sure if they can back out of lending to us unilaterally. I'm sure I have this information somewhere but haven't looked into it yet. First time buying a house so pretty ignorant on a lot of the process.

The lender does not have accept your POA. There are lenders out there who never allow a POA. Understand Freddie just gives when a POA can be used, not a requirement for a lender to allow POAs. They can and do make their own rules, and are not bound or required to bend to a borrowers requirements.

and if there is zero reason for that particular closing date and time, the agents plus your LO should have a talk and behave like humans and simply move the date a day or two. I find that once the final closing disclosures is out and the file has a clear to close, people usually get off the edge and pull on the same side of the rope.

If lender has no issue there are certain title companies that can get his sign as a Video Notary. We had this issue where the spouse is a non US citizen and also in Pakistan. They closed it by spouse signing over video notary.
