A friend of mine is having a problem… the recent storm ganases her fence. The landlord is not fix it. He actually took some of it down rather than repair it. My friend has a dog. This is a problem for her. She rented a property with a fence for a reason. He has stated he'll fix it if she renews her lease for two years at $75 more per month.

Is there any way she can force him to fix the fence?

Can she pay to have it repaired and fix reduce her rental payment by the amount of the cost?

I'm not sure what legal recourse she may have.

She can sue him and hope it falls under the "safety" clause. Not sure that juice is worth the squeeze.

If he's not fixing it, I highly doubt he'll reimburse her if she fixes it.

It sounds like she's at the end of the lease so start shopping for another place. If she finds one she likes, threaten to give notice unless it's fixed. If he doesn't fix it, give notice and move.

If she shops around and notices her rent is more than $75/mo below market, then take his deal.

Move on. When someone shows you what kind of person they are, believe them. They'll continue to show you what type of person they are in the future too.

Also, I'm petty enough where I would fix the fence such that my dog couldn't get out, but I would also make it very clear to future perspective tenants with a sign or some spray paint that says "This section of fence belongs to Jamie and will be removed at least termination." And then let the landlord deal with the fallout from that.

Completely agree. I would be willing to pay more to someone else just so that guy couldn't get another dollar from me. That guy couldn't get me back even if he cut his rates AND replaced the fence.
