You're right. Theft doesn't include the threat of violence against the victim. Taxation is armed robbery.

Divorced person, Brazos County, I was told 1 person = 1 exemption. If you are married, both names on the homestead exemption, then each person is half (0.5). One person can claim the entire exemption or it can be split.

As I stated, I'm divorced and own a different home from the marital home, however, I need an act of GOD to happen to get my 0.5 off the marital home so that I can claim a full exemption. I have called multiple times, my ex has called, and the tax office says it's easy to fix, they take my info, the woman that handles it will call me back, and nothing. Rinse and repeat.

I mean, that's all a government ever really boils down to. Rights (and taxes) are only brought into existence by the threat and/or act of violence. For better or worse, of course.

Some CAD's may have different interpretations of the tax code, and it is very difficult for them to put together something like single woman buying a home, and marrying a man with a home, then they live in one and never remove the exemption on the other for example, since each property is in a single different name.

Most definitions of homestead in the tax code, property code, etc define a homestead as it applies for a "family or a single adult" so a single adult can have a property that is a homestead, and a family can have a property that is their homestead. So the property of a man and wife is the property of a family and therefore the family is entitled to only one homestead at that point. Here is the line as it appears in the tax code in the section that grants the exemption.

Sec. 11.13. RESIDENCE HOMESTEAD. (a) A family or single adult is entitled to an exemption from taxation for the county purposes authorized in Article VIII, Section 1-a, of the Texas Constitution of $3,000 of the assessed value of his residence homestead.

Definitely can say I have seen a CAD remove a homestead and successfully have the removal upheld in protest hearings of a married couple because the spouse had owned property that was a homestead in another county. Its a fight that likely it would take lawyers to win unless you get really lucky at an ARB hearing and might be a total nonstarter depending on the legal case surrounding what a "homestead" is or isn't.

We're fortunate in that we have a second home. We don't attempt to homestead them both so we pay a full tax rate in an area our kids don't go school and we use fewer county/city services than a full time resident. Even if we were able to homestead both, I'd argue we are still paying more than our fair share

Graduate from a Texas High school or receive a GED. Reside in Texas for the 36 months immediately preceding graduation from a Texas high school or receipt of the GED. Reside in Texas the 12 months preceding the census date of the academic semester in which the person enrolls in an institution of higher education.

When I enrolled at Texas A&M I was only allowed to take 9 credits the entire year so I worked a part time job as well as went to school for the year. I also had to take the equivalent to the star test at the time. Now I got an exemption on out of state for the 9 credit hours because I was ex military but couldn't take anymore. At least that's how I remember it.

They will be caught and this plan is a loser and be told to pay out of state.

It's not but that issue is still tempting. LOL

Without going into too much detail this is a neighbor that we've never met who - without even talking to us - initiated some really petty legal stuff. A thing that could have been resolved with one conversation.
