In both houses I've owned, one side of the house had the fence just like this.

How could you even make it otherwise? I guess you could always skin both sides?

The new Texas State law has really restricted HOAs for enforcing fencing rules. You could put up a fence completely surrounding your home including in the front between your yard and the street and the new law says HOA can't restrict.

You need to be sure to use the phrase permission, when talking about the ACC.

The ACC doesn't issue "building permits" the way a county/city does, they just give you permission to do modification work.

They are being A-holes about the fence/gate because they didn't get a notice, I'd appeal to the ACC and Board in a joint meeting.

Supply the drawings, and tell them that it complies with the ACC/DRs for fence design, and it complies with the new state regs for security fences around property perimeters.

Apologize for not securing permission prior to the work occurring, but tell them that if it is not approved that you'll be retaining a lawyer and fighting it, as it goes against state regs/law.


I'm not totally sure the motorized opener is part of the law and may not be part of what they have to accept.
