I think Maldonado standing up and going into the throwing motion is enough "evidence" that he wanted to attempt a throw. It would be different if he sat in his crouch, but he obviously wanted to throw out there.

Agreed. Maldy should not make that throw for two reasons. One, he legitimately could have hit jd Martinez with the ball or with his hand after the release, injuring himself or jd. Two, almost no chance he makes an accurate through so he's putting it in the umps hands and risking giving the runner 3rd for free.
