If I was Ole Miss, I would fire him for cause, and sue LSU and UF for tortuous interference with an existing contract…
Take them all to court… In Mississippi, no less…
Let's see how much cost, program disruption and time consumption they're all willing to take on…
1. They're not interfering. For them to be interfering, they'd have to be doing something like paying Kiffin to lose games or something like that. (Of course, that would get him fired for cause anyway, which illustrates the absurdity/redundancy of this specific tort in THIS set of circumstances). Negotiating a possibly new contract isn't interference.
2. They're (LSU/UFl) definitely not doing it in Mississippi, so its very unlikely they'll be subject to Mississippi state court jurisdiction. Even if they were, if OM sued both UFl and LSU, I believe diversity jurisdiction would attach and removal to Federal court would almost be a certainty, but its been a long time since I dealt in that area.
3. Proving damages here would be extremely troublesome.
As stated above, as long as Kiffin informs Ole Miss of direct or indirect job contacts, he's OK. I posted that about a week ago.
