But if he was under the legal limit, not impaired and the weed wasn't (or can believably be the riders weed) his, why are you disappointed. The LEO might have had probable cause to pull over but in the end he was innocent. Or he was let off b/c he was an athlete. I wasn't there so moving on.

Hope he kills it this season.

That he's the captain of the team and chose to put himself in that situation. Also, I believe the privilege of being an Aggie on scholarship with all of the free perks means that he is held to a higher standard than a typical student.

Once I heard that he didn't test over the intoxicated limit (passed) and that the gun was legal, made one question why any charges had been filed to begin with.

Sounds like will be suspended at most just first game if Jimbo feels warranted to make a point, if even that. Might just be run a bunch of bleachers sort of thing or missing SEC media days was punishment served.

What situation? He didn't do anything....he was under the legal limit so he didn't put himself in a situation where he was driving drunk, he can't control his friend having a joint, and he was legally carrying a weapon because he wasn't breaking any laws. Time to move on, no suspension...thanks and gig em.

If I was in Jimbo's shoes, I would take his captaincy away and that's about it. Poor judgement but nothing to suspend playing for.

Why do people keeping saying this was poor judgement or he put himself in a bad situation? The only one who did anything wrong is the cop, he wasn't drunk, the joint wasn't his, and he was legally carrying a firearm.

If anything he was being responsible by not drinking more than the legal limit.

If he was on University Dr., why did UPD stop him & not CSPD? Where does the jurisdiction start/stop for UPD?

Those seem odd to be glossed over in all the uproar.

Rather or not the charges get dropped, this is what I understand happened.
He was speeding 16 MPH over the limit at 3:00 in the morning. That is why he was stopped.
He was under some sort of influence -rather or not over the limit
He did have weed
He did have a gun.
I am really not sure what the policeman was supposed to do!!
Now, we can all figure what is going on behind the scenes but wanted to defend
the blue on this one.

University goes through the campus, I don't think it's crazy for UPD to be able to pull people on or even near campus.

DA's can attempt to prove DWI by either a BAC or impairment (field sobriety test results). "Possession" isn't the same as ownership...it's access to and ability to control (move) the weed. It's been a pretty long time since I dealt with an unlawful carrying case so I don't remember the law on that.

A BAC below the legal limit is a good start (most arrested test over). Anias' attorney could also look into whether the field sobriety tests were administered properly (the nystagmus test, etc) if Anias didn't refuse to perform them. As far as the weed, when it's in the car and there are multiple people in the car - from what I've seen - there's maybe a 65% chance the PO will attribute it to one of the occupants if the occupant claims it's his/hers; but the PO can charge everyone in the car (with access/control) with possession.

Poor judgement driving at that time of night. Poor judgement of speeding at that time of night. Poor judgement of having any Marijuana in his vehicle, no matter who's it was or how much it was. Poor judgement for having consumed any alcohol or Marijuana and having a loaded gun together. Not anything I might suspend for but not the conduct I want for my Captain.

you CAN kick you friend our for having weed if you want to.

I actually had a friend in college that would kick us out of the car for not having our seatbelt on in the back. Now he didn't care about our safety he cared about his if we came over the front seat.

He's over 21, he can have a beer and it actually speaks to him being responsible that it was that late and he only had enough alcohol in his system to only have had a beer or two. He's a college kid, he can go out after midnight. No proof that he even knew marijuana was in the vehicle with him. Speeding?? Really? That is your poor judgement argument here? Come on.

I was on here yesterday saying if you are drunk, have pot, and a gun that is your fault and you deserve to be punished, but the facts have come out and none of that was true.

Nah, there still might be some 'bad judgement, should have avoided the situation' merit to some punishment, but seems now unlikely to result in any game suspensions.

Thus, from a Aggie sports fan perspective, this has become mostly a non-story.
