Isn't he a Baylor alum? I'm sure he is just carrying weight for the rapists. Ken Starr is gone but he hasn't won like 50 games over the last 5 years so he was the easy scapegoat.

He also said he know's Art and he is a good guy that has done a lot of good. Lopez should have mentioned the same could have been said about Joe Pa. You can't just overlook cover ups for stuff like this b/c he is a "good guy"
Starr is the scapegoat and Briles is fine b/c he wins football games.

I was listening this morning and was shocked at what McClain said.

I don't know the details of the sex assaults at Baylor. Any proof that Briles covered it up? Or did Art just not cut the guy immediately?

I have always thought highly of McClain, but what he said this morning is a bad look for him. He mentioned what Baylor should do to solve the problem. None of his suggestions involved changes to the football program.

Or you could setup some form of a department within your school to immediately investigate the allegations and then make an intelligent decision on the case based on the evidence...

If Baylor wants to pay me ~100k a year, I'd be glad to come up with some other great ideas like this... or they could just follow the damn government mandates... either works.

Baylor, Ken, nor Art gave a flying fudge about these cases until they spent enough time in "the news" ( or internet blogs, etc).

So, just because people will sue Baylor if they do something; so it's OK to ignore ALL accusations? Super. Let's also disband all law enforcement, because they are sued all the time. Perfect defense.

How different would things be if Baylor had at least responded and honestly pursued these things when they happened?

That still doesn't alleviate the issue of getting sued if you made a legally incorrect decision. See Duke Lacrosse or the Mattress Girl case at Columbia for further examples.


If you do a legitimate investigation, and turn up enough evidence to have a reasonable case under title 9, your chances of getting sued are very slim.

Furthermore, Baylor ... a PRIVATE Christian school, could error on the victims side much easier.

I would be very careful of the Title IX process. It's extralegal and affectively denies due process to the presumed perpetrator. The use of Title IX language to construct an abortion of justice in the name of not allowing the presumed victim to be tangentially harassed is horrible regulation and worse law.
