Title Question.

Try to keep this short. Father passed away 8 years ago. Mom handled all the paperwork like a champ but never transferred the title of her car into her name. I have kept it maintained and inspected through the years but never even thought about the title. She is suffering from dementia now and I had to take the car away and she wants to sell it. I get the title and it is still in my fathers name.

Do we transfer the title to her name so I can sell it or is there a way to sell it and transfer the title to the new owner? Trying to get a game plan before I go too much further and hoping someone has some experience with this.

When your father passed did you ever go to probate and have your mom named as the executor of the estate? If so she can sign her name on the title and write "executor of <fathers name> estate" after her signature.

Lookup Texas affidavit of heirship for motor vehicle. I think it will accomplish what you need.

When my brother and I settled our mother's estate I just signed (forged) her name on the vehicle titles. I didn't tell any "authorities" she died. That was 20+ years ago and it hasn't haunted anyone.

It is not a big deal. Just sign and move on. KISS.
