God-Family-Friends, I am pretty sure to get capital murder and therefore be eligible for the death penalty there are specific things that have to happen. Things like murdering a cop/firefighter in the line of duty, murdering someone under 10, murdering someone while committing a violent crime like kidnapping, robbery, rape, etc. I'm not sure all of them.

Not in Texas. A guy I served with is on death row for murdering his girlfriend and her brother because he was jealous.

That's another one of the specific instances. Murdering more than one person at the same time.

I don't know if the law has changed, but according to this article, a life sentence means a minimum of 40 years, with no data on parole rates at the 40 year mark (since none of these cases have come up yet). If the DA doesn't get greedy, this should be a pretty easy life sentence, wouldn't you think? What a waste...

Guy posted $50,000 bond instantly and was indited by a grand jury in December. Will face first-degree murder. Doesn't appear to have any action since.

$50,000 bond must be the going rate for murder suspects? The lady on my street that is charged with killing her husband posted the same $50,000 bond and each month the defenses asks for more time. She was charged in August 2014 (murder happened in December 2012). She supposedly stabbed her husband, so maybe the $50K is standard knifing bond? (sarcasm there).

Saw an unrelated news clip a couple days or weeks ago. Someone was out on bond for murder charges and killed someone else. They stated his bond was $50,000 and that is standard for Harris county murder charges. Unless they are a flight risk, have a record, etc.

I think the 50k is pretty standard in Harris County. I'm assuming the guy didn't have priors.

As far as the death penalty goes, I'm pretty sure it is only for capital murder cases. To have that charge, a person has to kill someone while in the process of committing another felony. This case doesn't have that, hence just the murder charge.

I'm not a lawyer, but I write enough about crime. Texas doesn't have a first or second degree murder. It's either capital murder or murder. The step down after that is manslaughter.

I went to Klein and there's for sure plenty of spoiled rich kids driving Mercedes to school.

I think if the defense attorney has a good relationship with the judge and/or the DA that can play a big role in the proceedings. The defenses goal is to put this off as long as possible so its not fresh on peoples minds. It has not been in the news much since the incident happened so that is good for the defense as well. I'm sure the accused will go the self defense route so it will be interesting to see what happens.

I might go just to hear the gf's testimony.

Any update on this? Is this guy still hanging out in Houston, avoiding prison?

The DA recused themselves from the trial. Loretta Muldrow will be prosecuting.

In the case I referred to before (this same page), they convicted Melgar for killing her husband...she got 27 years and is now trying to get a new court date. Her trial was just this past summer.

You can got to the Office of Harris County District Clerk website and register and then be able to see a lot of the info.

Is/was this really the gf of the killer? And I used to live in the Klein area....there are poor sections and really nice sections...pretty much same as all of Houston.

She looked like that about 10 surgeries ago unfortunately.

As posted on the other thread....June 15 is now the new Jury Trial date. Some interesting documents to read about the case on the Harris County Clerk's office website.

Sounds like the guy who was killed had some major issues. The defendant wants to be able to bring those past actions up during the trial and the State wants to suppress it.

Trial started yesterday. Crazy it took nearly 4 years.

It doesn't help that the Criminal Courthouse was destroyed in Harvey (but not because of Harvey) and has therefore been sharing courtrooms with the civil courts.
