Find out what the procedures are for removing board members, or even better, dissolving the HOA entirely. If you can, try to get on the board yourself. Chances are, you are not the only person who is annoyed with the HOA and you shouldn't have much trouble gathering support to at least remove the malcontents from power.

I served on my townhome HOA ITL a couple of years back (very small community). For the love of God, don't listen to this guy. A couple of bull**** letters from the HOA is a much easier nuisance to deal with than the epic *****ing and moaning as well as red tape hell you have to immerse yourself in on even a tiny HOA board.

Agree with the others who say your situation is extreme. I currently live in a deed restricted old neighborhood and previously lived in West U where I had a busybody whack job for a next door neighbor, but never experienced anything like what you're describing.

I would try to talk to other neighbors to see if they're also being harassed by the nut job down the street. As others said, people often think of the HOA as some faceless entity (and in some neighborhoods it is) but the problem is usually with one neighbor who has way too much time on their hands. I'd even try to photograph the dude to document his odd behavior as he makes his rounds.

Onlyfornow, I think you are confusing public finance/real estate development attorneys ("MUD attorneys") with HOA attorneys. Totally different practice areas and types of entities represented.

Call my buddy Lee Thweatt at Terry & Thweatt. He represented that Marine that got in the HOA dispute (and won) regarding his flagpole. He's reasonable and knows how to deal with HOA suits. EZ

Let us know how this turns out. This could end up removing all the bullcrap powers these HOA's seem to have! IF you can beat Cinco Ranch HOA, then you can probably beat any HOA!

can you email me a copy of your CC&Rs and anything you have from the HOA? i have been on the board in my hood as pres for 3 years. stepped down from that but am still on the board. i got involved over the daily usage of a utility trailer to move in. i would be happy to read the stuff, and give you my thoughts, along with talking to the atty for our HOA. we talk on a regular basis, and i can squeeze your issue in.

Only: that is really surprising, as my firm has the same type of practice as ABHR and I've never known them to represents HOA's. Not saying they can't or don't, just surprised they do. Out of curiosity, which subdivision is it?

Wow. I would simply not reply back to them except to say you've complied with the letter of the HOA rule. If they sue you, retain an attorney, counter sue and be ruthless about it. I doubt they will take you to court, because they would lose and spend a small fortune in the process.

I had an issue with the HOA "violations" board member. She basically drove around the neighborhood looking for **** that was wrong. She forgot to look at her own house, b/c I went and did it for her. She had a bunch of green crap growing all over her siding on both sides of her home. I reported her and she's no longer on the board. You could just find stuff wrong with the yard of the guy that lives down the street from you. Or just steal his plants. Be sure to report his ass if you do.

My parents had a gate installed in their driveway (this was in Sugar Land) The gate had decorative tops on tops of the posts.

Of course they get a letter saying that the post tops have to be square and non-fancy.

It went back and forth and got pretty ridiculous, so my mom drove through the whole neighborhood and wrote down all the houses that had similar gate tops and sent that back to the HOA saying all of those people better have gotten a letter too. She added that surely the HOA wasn't singling out the only Hispanic family in the neighborhood.

She never heard another peep from the HOA.

Do what someone in my neighborhood did. Print up a boatload of flyers and go door to door with your neighbors summarizing the situation and pointing out the architectural improvements committee is essentially targeting and harrassing you.

Then ask for them to help you remove them on the next board meeting.

My HOA is generally fine. Most of the letters I got were legit stuff I needed to deal with, and I did.

Only once I got a letter about the siding on the back of my garage, and the area that needed attention was ONLY visible from private property, so it had to have been trespass, or one of my neighbors to the back ratted on me.

I basically went into my back yard and ranted really loudly that if someone wants to start an HOA violations war, I was willing to go nuclear on it and take down everyone in my section of the neighborhood with a flood of violation reports, and that seems to have stopped it.
