I have a young friend who got run over here on Texas Ave last year and they finally settled for a few hundred thousand. He told me that the attorney get half of it.

I know it probably varies greatly, but is a 50% attorney share about average these days?

No, most PI firms are 33-38% and only if they win.

1/3 used to be pretty standard, but nowadays 40% pre-lawsuit and 50% after suit is filed is becoming more and more common. What percentage did his contract with the law firm contain?

The firm may pay their expenses before splitting the money also - doctor, accident reconstructionist, etc. May be getting percentage of what's left.

Yes, that aspect can really hurt you on what you get at the end.

It would be interesting to see if there is any statistics on comparing an original offer by insurance companies and 50% or less of the actually settlement an attorney is able to negotiate especially if all the expenses are paid before the split.

This accident occured last September and now just getting settled.

Some years back Mrs Mathguy was hit from behind by a kid who was too busy taking selfie with his dog to pay attention to the traffic.

Expenses first, then the subrogation (which sucks) where you actually pay back docs and hospitals what the insurance wouldn't pay, then 1/3 split. Which goes to 40% if they actually had to file in court to settle and then 45% if it went to trial.
