My Nieghborhood kids using my drive way for skateboarding. I don't have a issue with them doing this, as long as one of them doesn't hurt themselves, and then have there parents suing me (this situation happened to my wife's parents when she was little)

Any ideas of remeding this? I really hate the idea of no trespassing signs (I think they are tacky, and don't aid in keeping a good relationship with neighbors), My insurance agent suggested going to there parents and having them either sign waivers (again not excited about this)

Wish there was a law that protected against this sort of thing.

Just rip up the concrete and put in a gravel driveway. That way you never actually have to confront anybody. Sorry for stating the obvious.









Seriously though...no one is going to sue you. Unless you're somehow encouraging them to skate on your driveway there's no way a judge in their right mind would say you were responsible if they got injured. For all they know, you know nothing about it. At least that's how you would present it.

Stand in the driveway with this paintball equipment on and they will stay away.



Or you can go this route, but you'll need a gate.

We live on a very conveniently located corner lot and our circular drive curves through the front yard from one of the streets to the other. People use our drive for everything! - a shortcut while walking the dog, a shortcut while walking, a shortcut while riding scooters/bikes/skateboards. At first, it annoyed us a little, but now we are used to it, and sometimes get waved to if we are at the kitchen window. The only thing that remains annoying is when people use it as a turn-around at night and their big headlights make the rounds through our living room. - We've debated setting black iron lawn furniture out there to stop that.

But, from a parent's perspective, if my kids were riding/scootering etc. on someone's driveway, I would not at all mind someone telling them that they want them to stop. And should they not stop, I would want that someone to come express their concerns to me.

I'm aware of what people are capable of and capable of getting away with - i.e. suing mcdonalds for being fat blah blah

I just really don't think this is something to worry about in this case.

I have to agree with the other poster that to no be concerned is pretty Naive. The reason it presents a concern in my mind is because it already happened with my wife's parents (i posted this above but here is some more info). A Neighbor kid (this happened in Bryan) decided to climb a tree in the front yard. The branch he was on broke, and he fell and broke an arm. They got sued over it for the medical bills, and it went as a strike against her (my wife's) parents homeowners insurance.

I would be concerned

even though a potential lawsuit might end up going nowhere, you still have to go through all the headaches associated with it. And that could be a couple of years worth of headaches.

I would be concerned as well. Its a shame that we have to think about these things, but we can't ignore the fact that there are people who are quick to blame others for everything and are quick to sue.I think you could have a conversation or two with the parents of the children involved or even the kids themselves, without being a dewsh. Just end it withsomething like "I love seeing you/your kids out here having so much fun, but with the steepness of the slope, I'm afraid one of you/them will get hurt". Maybe even record the conversations and the date, just to protect yourself.

Make an effort to be friendly on a regular basis... Visit with the kids or parents when you see them out and about, etc, and let them know you're not some old killjoy.

hmmm. don't think "attractive nuisance" applies here, and the kids are actually trespassing - so you should be good. However, one of our resident law dogs could prob. chime in on how this might play out.

Would parking in the driveway eliminate the problem? If so, that seems the easiest thing to do.

i would start with asking the children directly not to skateboard in your driveway.

if not resolved, I would tell their parents you'd prefer their children not skateboard in your driveway

if not resolved, sternly ask their parents to not allow them to skare in your driveway

make note of the dates you did each of these. if still not resolved, take pictures of them skateboarding in your driveway, call the authorities, explain your previous requests, and ask them what your next step should be?

as a child, i used to rollerskate down a neighbor's extremely long and steep driveway until one day they asked us to stop because they were afraid we'd get hurt. it wasn't a big deal. we moved on to someone else's driveway. hopefully the same will be true for you.

They're trespassing... And you for some retarded reason can be found liable if they hurt themselves while on your property.

Sorry but I'd have to be the a-hole on the block and either make the parents of the kids lawyers write something up about you not being liable for said kids or that the kids are not allowed on the property.

It sucks but in today's society that is really all that works.

If you have sprinklers turn one or two heads to water the driveway during the hours they skate...

Put up a sign and can requesting a concrete use fee.

Put out a sign referring to the "dirty old man" or other equally (or more) offensive being who lives in the house. The parents will take care of keeping the kids away!

For what it is worth here is my take on your predicament...The only way it would make you liable for the kids is if it is an "Attractive Nuisance". Meaning you have something out of the ordinary in your driveway like say a plywood jump ramp that is not temporary but there for some time. Your drive way is considered in premise liability terms as quasi public property, and attractive nuisance applies, in that it is a way to and from your front door. There is more protection than a Walmart or even a Walmart parking lot because the skate boarders are not invitees (unless you have invited them to skateboard at your house whenever they want) but it is the same for the loading dock of Walmart or any food store regarding skate boarders because that is not its intended purpose and they assume the risk. I believe a sign saying "no skateboarding on the driveway" would definitely help. Also a letter to the parents letting them know your concern would strengthen no liability on your part, assuming you are as concerned as you appear to be.

only and mymain's driveway is awesome for skateboarding. Been there, done that...

I hope I did not flash yall too bright, while putting signs in the yard the other night!

We had a tempting sidewalk at our former home. I always let them ride out there, as long as i could take a turn whenever I wanted on their boards. I quickly became the cool old guy (though I was 31 when this started), and the kids treated us very well.

If you wanted them to stop, you should just tell them direct IMO. Explain the liability is too great, and you cannot allow it anymore. If you come off as on their side, hopefully they will understand. Good luck!

it's unfortunate, but yes, you would have a liability issue if they get hurt on your driveway. Even if the judge rules in your favor, you're going to be out thousands of dollars in legal fees.

I would follow Chuck's advice and ask them politely not to skate in your driveway.
