Finding an oil and gas lease on file…

I have a property in Guadalupe County and I am not the mineral rights holder. I have the property on the market for sale currently. The property has a few pump jacks and I know that there is an active lease on the property. My realtor is pressing me to get a hold of the copy of the lease, but I have had zero luck getting it when I contact the Oil and gas company. They tell me that they will look for it and get back to me and then I never hear from them again. I have had multiple messages and phone calls with them.

Is there a database that I can search to try to find a copy of the lease that applies to my property?

I think the lease was taken out before the larger property was divided into its current form so it could make it challenging since I won't just be able to search by address.

Edit to add: we have contacted the title company that we used to close when I purchased the property and they don't have it and I can't locate my papers from the closing either.

Go to the Guadalupe County clerks website, and run the mineral owner as grantor.

Depending on how old the lease is, a complete copy of the lease may not be in the public records. On newer leases, they only record a memorandum of the lease for notice.

I had to dig up some old records for one of our properties in Guadalupe county and went to the county courthouse in Seguin. The ladies in the clerks office were very helpful in helping us find what we needed. Worth a shot.

Go to the courthouse and search their records. I've done exactly what you're describing down to the lease being attached to larger pieces of land. It is very confusing, good luck!

The ladies in the court house are usually pretty helpful if you are a local or a landowner. If you're a landman, it helps to bring a box of donuts once in while...

The origional lease may be in the old books, but there is most likely a memo or updated lease on the court house computers.

Be overly polite to the courthouse ladies.....and you might take a box of donuts anyway.

Tell your realtor to get off their ass and go find it. Probably expects 3% for hanging sign out front.

I can probably get you the Lessor's name and recording info if you have the well name or API number. I am a landman, but don't have a subscription to Guadalupe county records so you would need to get a copy in person.

I don't know if Guadalupe County will have docs on the web. You can use Texas file.com.

Like a poster said above, if this is relatively new they probably filed a memorandum in lieu of the actual lease.

Guadalupe has their records online. It looks like the search is free, but to download docs it's $1.00/page. There are two searches: pre-1970, and post-1970. Texasfile.com is probably easier.
