ATF strikes again: Beretta 1301 7+1 import ban

Was planning on getting one sometime in the spring, but some ATF shenanigans popped up last week or so and now they are on the import ban list and Beretta is following through. They will pump up their 5+1 configs. Still some questions floating around though.

Main one I have is that I think they manufacture some of them in TN which should skirt the 922r rule, yeah? My knowledge on all of it is admittedly quite hazy though. Thoughts?

I am not a crazy constitutionalist or bust guy, but I do scratch my head at how the ATF, which is not in the Legislative Branch, wields so much power and well, effectively legislates law. Irritates me to no end.

I'm not sure why you think that. The last time the ATF got their hand slapped was because of a Trump order to the DOJ to ban bump stocks. Trump is the one that told them to redefine a machinegun to include bumpstocks the ATF had previously said they were fine.

Acting Attorney General Whitaker made the following statement:


"President Donald Trump is a law and order president, who has signed into law millions of dollars in funding for law enforcement officers in our schools, and under his strong leadership, the Department of Justice has prosecuted more gun criminals than ever before as we target violent criminals. We are faithfully following President Trump's leadership by making clear that bump stocks, which turn semiautomatics into machine guns, are illegal, and we will continue to take illegal guns off of our streets."

On February 20, 2018, President Trump issued a memorandum instructing the Attorney General "to dedicate all available resources to… propose for notice and comment a rule banning all devices that turn legal weapons into machineguns." In response to that direction the Department reviewed more than 186,000 public comments and made the decision to make clear that the term "machinegun" as used in the National Firearms Act (NFA), as amended, and Gun Control Act (GCA), as amended, includes all bump-stock-type devices that harness recoil energy to facilitate the continuous operation of a semiautomatic firearm after a single pull of the trigger.
Because the final rule clarifies that bump-stock-type devices are machineguns, the devices fall within the purview of the NFA and are subject to the restrictions of 18 U.S.C. 922(o). As a result, persons in possession of bump-stock-type devices must divest themselves of the devices before the effective date of the final rule.

You're leaving off the qualifier I put in front. Meant one of those crazy quasi anarcho types who don't believe in drivers licenses and law enforcement and such things and won't STFU about it.

If there is any shred of truth to a downsizing of federal departments, the ATF HAS to be one I would assume. Of all the rampant over reach of said departments, they have to be in the top 3 I would think and they don't have many friends I don't think in the upcoming admin.

Granted downsizing does not equate to limiting purview exactly so in the end, as with most things, we shall just have to see.

Think of what it would be like if it applied to things like TV's, refrigerators, cars, computers, etc.
