Lots of rope swings on Lake Livingston. Of course they are generally attached to boathouses on private property.

That's OK bud, got it covered at our place including a jumping platform above.

Also...make sure there are chicks watching.

Then, report back to us and remember rule 1.

In 2008 there was a big one in Gonzales on the banks of the Guadalupe near the 183 bridge. We tried to take a little nap there during the Texas Water Safari.

Yes sir. Family member on wife's side had a ranch in the hill country upstream from a summer camp. Kids kept crossing his fence to use a rope swing he had. He put no trespass signs up they still did it.
A kid held on the rope too long and fell into some rocks on the bank. Broke his neck and is a quad now.
Parents and hot shot attourney in Austin sued the estate. Cost them thousands to defend.

There is almost certainly more to this. First, insurance would have covered the defense and a good part of the indemnity, had there been any liability (which there shouldn't have been). Second, premises liability in Texas is pretty clear -- landowners don't owe trespassers legal duties other than to not harm them directly (in general). The law may have changed slightly in the dozen or so years since I litigated this issue but I'm sure it isn't substantially different. Had they not been insured then I guess they'd be out defense costs, but this is really a case where the law is so clearly, it is almost malpractice for a defense attorney to not at least threaten sanctions against the Plaintiff's attorney for filing suit absent other facts unknown. A simple "jumped the fence, played on the rope and got hurt" isn't enough. However, I will tell you that insurance companies freak out at the thought of large damage awards REGARDLESS of the overall risk of liability in the first place. I've seen/had cases where the insurer was so concerned about the case because the meds were high yet I told them that liability was almost zero, so they shouldn't worry (I ended up being right).

Things get trickier when you're dealing with municipal and governmental liability, particularly premises liability. They also get much trickier around water.

Anyone else remember the rope swing at Millican Falls south of College Station on the Brazos river? We used to hit that place up when I was a student.
