Background check 'delayed'

The feds to mess up a good amount, I had multiple agencies calling me for 2 years about a warrant for something with a similar name, not even the same. Finally went away after getting a lawyer involved and the fact that I didn't even have a ticket to may name helped too.

i disagree. it's not the FFLs job to determine who can exercise their 2nd amendment rights. if the feds cannot get their crap together, that is on them.


But it is their job to decide who they sell to.
Only under certain conditions.

For example, if they decide not to sell to somebody because they are a muslim, they get sued. Same for not selling to a woman, or a black person, or a Mexican because they think he's a cartel member on the basis of him being Mexican. Or gay or trans or whatever other made up protected class we have these days. Stores have to be careful about who they decide not to sell to these days, which is really kind of unfortunate when you think about it.

If I were the OP, I'd either go buy it for my kid (hell, take him with you and gift it to him in front of them just to be a thorn in their side), or find it elsewhere and let them know they lost business because of what amounts to a stupid policy. I'd also contact the local ATF branch and find out why there is a delay, and why the delay is taking a month or more so that I might see if there is something that can be done to fix the glitch in the matrix.


No, under all actual conditions. The Constitution didn't apply to private businesses; they can choose or choose not to sell to whoever for whatever reason.

And if you want to get cute and play games by bringing up the goofballs in Colorado and LBGTQ cakes, then find a liberal court to rule on this issue and they'll back the store because guns are evil. Find a conservative court and they'll rule that citizens do not have a right to buy any certain item from any certain vendor.

Either way, it is up to the store who they want to sell to. If the son has a problem with it, he should take his money somewhere that wants it badly enough.

Now go away and hide from the rain.

Sucks that govt incompetence is holding it up, but it's Scheel's right to play it cautiously. We see Eye Guy out here commonly referring to situations where if he feels hanky about a buyer, he won't sell them a gun. Well, this is big corporate's hanky feeling when they don't get a clearance back. Go deal with the source of the issue vs Scheels.

And this is why I made my earlier point that I agree with a businesses right for who they choose to do and not do business with. I'm by no way a proponent of red flag laws, but I'm certain that we have all had that feeling every now and then when something about a person or situation just ain't right.

When I was shopping for a gun in Carters Country 12 years ago, a couple came in looking for a pistol. Once one was selected, the process of purchase began. I was being nosy so I stayed close because the dude felt off. I HATE Carter's country and I was purely there to find the gun so I could buy it somewhere else because their staff are toolbags. However, the couple was handled correctly. The dude "forgot his license" and the staf told him they could not sell him the gun. He got upset. They left to look at other stuff and I gave the clerk a raised eyebrow. Then these two came back and the wife produced her license and said "I want to buy that gun instead". The staff rightfully understood what she was up to and they put the kibosh on the purchase completely. They recovered all their kudos back from me that day.

The store can refuse a sale to anyone they want and they should sometimes.

I'm not a lawyer, but the buy it for him doesn't seem wise. Something about buying a gun for a person that cannot buy one and then giving it to them or selling it them screams straw purchases. Caution Will Rogers!!!

He was not forbidden from buying a gun. Only not allowed to complete the purchase per store policy, not per any laws.
