My plan that was approved and then denied was for songbirds. Again, denied because my property is smaller than 400 acres.

Yeah, I would say you have a pretty good case to challenge that.

There should be plenty of categories for you to have approved. On mine I did a "deer survey" but was told specifically that it would not count because the property was not big enough, so we did that category anyway but also threw in others that DID count.

I do it on my property. I'd recommend that if you are planning on buying any equipment like a tractor then do it while it's still ag so you don't have to pay the taxes. The paperwork is not hard for the wildlife exemption. Just keep receipts and photos of what you are doing. And, if you are going to go the wildlife route I'd say try to make it count for the wildlife and not just go through the motions for your tax break.

Contact Plateau Wildlife Management. They handled this exact issue for me.

Easy to continue in Milan County. We've got 111 acres south of Thorndale and easily rolled it over when we bought 3 years ago.

We had a similar experience in another county. We sued. They dragged it out and were non-responsive to court orders hoping we'd give up. We didn't. Currently in year 5 of wildlife management.

Drives the counties bonkers, but I very gotten several properties certified managing for pollinators. But I should add, they all have to be very active in what they are doing......and if they argue I can flip any of them to songbirds.
