Dude filming doesn't seem to feel in any danger of getting shot. I don't think I would have stood there filming it...

Apparently he also shot at one of the employees up in the bucket...

I agree that he will and I agree that he should.

It's amazing to me how people want running water, natural gas, TV, Internet, but are horribly impatient with the working folks who provide it.

I think a guy like him (the guy shooting) should be unable to get any type of utilities from now on.

Turn off every valve and cut every wire to his house, even after he gets out of jail.

At times, I like to say my 76 year old father's "give-a-damn" is busted. But this old guy's give-a-damn is as busted as a give-a-damn can get. He's going to do some serious prison time and will probably end up wishing that AT&T would service his cell.

Wow, he was released without a bond hearing. Told the cops he went "bananas".

Think we'll hear about this getting reevaluated.

Well, the sheriff arrived with his bathrobe on
The confrontation was a tense one
Shook his head said, "Bubba Boy, "
"You was always a dense one."
Reckless discharge of a gun
That's what the officers are claiming
Bubba hollered, "Reckless! Hell!"
"I shot just where I was aiming."

His release probably has more to do with him being a retired fireman than his race. "Professional courtesy"

Definitely Florida.
Attempted murder? For shooting at the tires? Reckless discharge of a firearm, destruction of property, criminal mischief, yes, but AM? No.

ETA: prob agg assault too for pointing the gun at the worker before shooting the tires out if that statement is true.

He wasn't committing a stated felony during the time (that would actually make it attempted felony murder), so you'd have to prove he intended to kill Ramos through a predetermined plan which I don't think you can with a one-off shot that missed (out of 18 fired).

Maybe attempted manslaughter.

Technically he as destroying a vehicle by means of explosion (the explosion of gun powder in the gun), which constitutes 2nd degree felony in Floriday. So with arson involved, he could be charged with attempted murder.

(please turn on sarcasm meter before arguing this statement)

He was probably provided a lawyer through the firefighters union. Without priors and as a property owner being released on bond for an aggravated offense without seeing a magistrate probably isn't common but not unheard of in an area with 2.7 million people. More than likely his lawyer called a friendly judge who set the bond/bail amount over the phone with the city or county jail. No doubt he probably did have some type of preferable treatment.
As with most first time offenders (if that is the case) he'll probably plead out to a lesser offense pay a large fine, restitution and may see house arrest, ankle monitor or something but any actual jail time will be small and will probably be suspended with his firearm being confiscated.
Don't know if Florida has mandatory sentencing for all crimes committed with a firearm but if so he's probably screwed but don't underestimate the abilities of a good lawyer.

I think the bigger question here is what would YOU have done had this been your neighbor? Do you confront him or simply keep an eye on him and hunker down? The guy filming is just plain stupid. Way to put yourself in harm's way on purpose. Idiot.

I'd have taken cover in my casa and called the popo. You never know when it's an old guy looking to just destroy property or an old looking to mow down whatever is in his way. Could be he just decided today was a good day to die and shooting some people before the cops shoot him is how he's decided to end It. Judging which is not a judgment I want to risk being wrong about.

I agree with above. This isn't about legal or illegal, it's about what kind of lawyer he gets.

Maybe this was one of those typical city jobs where a good man, a truck and a shovel could have completed the task in 10 minutes but att trucks have been idling outside his house screwing around for 3 weeks? Not that it's any excuse. I've done contract jobs when I was young. I know how that gig works.
