So

Is there anything Against the law about drinking on a yak? I am aware of boating while intoxicated but since the yak doesn't have numbers would I qualify?

I'm serious, I am asking for a friend. I fish to hard to waste time drinking a beer.

I want to know this answer because I'm buying a kayak and I plan on drinking beer while I'm out.

Menace to navigation perhaps ?
Never underestimate the creativity of Texas Law Enforcement!

I believe the answer is yes but you have to be monumentally stupid to get that ticket while in a kayak ie obstructing the boat lane or boat ramp or endangering yourself or people around you.

Probably has to be motorized to get a BUI but you could always get a public intoxication if you have too much.

You will not get a DUI while paddling around. A public intoxication is always a possibility. But that is only going to be from acting stupid. The biggest concern is driving home after fishing

No judgement each to his own. Why do people feel they have to drink doing everything? I don't get it. So many accidents outdoors would never happen if alcohol wasn't involved.

A friend was so drunk on a hunting trip he couldn't aim. Another friend kept falling into the stream on a fishing trip ruining it for everyone.

I guess I just don't have a need to be buzzed all day to enjoy the outdoors.

I think more appropriately would be, why do you need to drink so much you get stupid. I'm typically too busy casting to drink beer in my yak. But the few times the fish weren't biting and I actually had a beer in the cooler, it was nice to drift for awhile and enjoy a cold one.

Getting too drunk to aim or too drunk to stay in a damn boat is ridiculous. I don't think that's the norm for most folks.

Drinking a few beers while floating down the Mckenzie in Oregon just sounded like a great idea last August. I like floating around with a fishing pole in my hand and drinking a beer...I don't always drink beer outdoors but I'm damn well not opposed to it.

You heard of this thing called "self control"?

Just because I like to have some beer when I hunt or fish doesn't mean I'm going to get ****ing wasted. You've got some dumbass friends.

This may come as a shock, but sometimes "fishing" isnt about actual fishing. Same for hunting.

Its important to live your life as you see fit. Giant government inventing laws to arrest anybody anytime is out of hand and must be stopped.

Boat DUI arrests mostly occur at the boat ramps. With a yak you can put in almost anywhere so avoid the public ramps.

I don't drink. I'm just sick and tired of seeing good guys work all week and from Jan-May for giant government and not be able to drink some beers and go fishing without the worry of Barney Fife (whose salary you pay) arresting you!

So much this. These days I only get to fish every few months and I don't care if I get skunked, I just enjoy the hell out of having a beer with my old man and brother.

If I'm kayaking whitewater (even little class II rapids), no way am I going to consume beer while doing so. That's asking for something bad to happen.

But, when we raft and kayak the Kennebec in Maine, the first half is class III and some IV. At the mid-point take out ramp, we pull over, make lunch, and bust open the Pabst. Spend the rest of the day floating the river telling lies and drinking awful beer. We'll stop drinking long enough to navigate around some obstacles.

If I'm in a fishing kayak and floating a tame body of water, wear a PFD and don't get crazy.

Just don't drink so much that you get stupid and dangerous.

I've found kayaking to be a difficult endeavor with only one free hand. Same goes for ZTR mowers.

PI is a possibility anytime in public. Like other things in life - just be smart, have a good time, and don't ruin it for the rest of us.

like i said in the op. i have a close friend who wants to fish but she mostly just wants to drift around and kinda fish and kinda drink, if anything it would be more recreational because she doesn't fish that hard. on the other hand im the polar opposite. im too busy and to focused to have time to drink when im hunting or fishing. but im a whiskey kinda guy so dont worry, ill catch up when the work is done. this will be at shoalwater bay in POC so i dont know how public that is (unless everything outside of your house is public)

thanks for all the info.

I will add that drinking while fishing or hinting is just fine, but if you are the type of ******* that leaves your cans behind or sinks them because you are too lazy to take out more than you came with, you are among the lowest scum on earth and i hope bad things happen to you.

I had buddies that would sink them while we were at the lake and that pissed me off bad.

BWI requires a 50 hp motor in Texas. Paddle away and stay thirsty my friend
freakwastaken
How long do you want to ignore this user?
It is possible but unlikely. In Texas you commit the crime while operating a water craft while intoxicated. Like most things with the law you have to look and see what Texas defines as a watercraft. A watercraft is "a vessel, one or more water skis, an aquaplane, or another device used for transporting or carrying a person on water." However, if the watercraft is only powered by the current or water then you are good. A kayak would fall under this definition. So it is possible to get a BWI but higly unlikely.
ursusguy
How long do you want to ignore this user?
You'd pretty much have to be an idiot to get tagged drinking in a kayak. Technically, they can ticket you for BWI in a kayak, but not real likely to happen. Where the 50 hp motor comes into play is whether or not your drivers license is automatically suspended.

I drink pretty much anytime I have the excuse. However, I NEVER drink before or during handling firearms.
