Former UCS Employees - Labor Practices RE: Overtime

Any former full time employees from UCS out there? I just wanted to touch base & see if any one else received a letter from them about their overtime pay b.s.

Basically the way they paid overtime, for non exempt ovettime was on the 1/2 pay scale. Every hour you worked overtime cut your pay in half to where after 3 or 4 hours you are basically making nothing to stay there.

Anyways, yesterday I receieved a letter (and a check) saying that they want to "avoid any confusion regarding this practice by changing its practice of docking non-exempt employees....as such you are receiving the below describede payment." Which they say is the difference between what I would have earned being paid time & a half versus what I did earn being paid 1/2 time.

My main question is...did anyone else get one of these? Do you think I should cash it ASAP or should I give them a call about it & grill them over the whole thing?

Any suggestions? By the way...waht a ****ty company to work for.

I'd post it on the B&P board. Sounds like they think they may have violated the law and are trying to clean up the mess as cheaply as possible. I don't think I would run out and cash it just yet.

I was only part-time and never worked more than 39.98 hours, but I heard the yactually fired some people for going over 40 hours. Damn, UCS was a fun place to work though as a student b/c our managers let us set our own hours. I feel sorry the lifers there though.

I worked there a while and if there's anything I learned, it was not to trust them. Don't cash the check yet. I saw them yank money out of people's accounts many times because they had direct deposit and anytime UCS realized it screwed up, it would take money back from you with no notice whatsoever.

There used to be a very long thread on here about war stories from UCS...

not really sure what law they would be breaking. at my place of business, when we were bought out, the new company decided to no longer pay over time, but still expect us to work it if we need to.

Ummm, Overtime pay (most typically at time and 1/2) is mandatory in the State of Texas (and most of the US) for non-exempt employees.

So unless your job duties meet the Federal definition for exempt status, you are owed overtime.

So yeah, UCS is once again breaking some law.

And agdaddy04, your company cannot randomly choose to not pay overtime and then force you to work. At least not legally.

This is all part of the Fair Labor Standards Act, btw.

When I was there, I was exempt and told that they only paid us the diminishing overtime out of the kindness of their hearts. They were not legally required to pay us. No idea how they handled the non-exempt.

Or you should have been classified as salaried non-exempt.

And from what I know of UCS, that's probably the case, they knew the risks, and kept doing it until someone sued them.

Like just about everything else they do.

you should request a copy of the employment agreement you signed when you started with UCS. if you did not sign a clause agreeing to the "fluctuating work week overtime" practice, then UCS committed a breach. i would not put it past them.

I worked there fulltime for over a year back in 97 or 98. That double declining rate for overtime was bs. I wouldn't mind seeing some extra cash from those cheap *******s.

just got a call from a friend who used to work there...

does anyone know what is going on with this? I assume if he cashes the check, he gives up any claim for an upcoming lawsuit

What they have done is payed out based on the state law which goes back to the last 6 monthes of pay. If you file a claim in the national system, they go back two years. You have to wait a while but you could get a bigger check.

I don't think that's right....

according to the people I have talked to...they went back 2 years from May and paid the overtime on a time and a half scale, using a 40 hour work week as a norm for base pay, only if that person had been docked at least one days pay during those 2 years...people who had not been docked were not eligible, even though they were exactly the same in every other way
