Hi,

Anyone have a good one? My husbands company is withholding 8 hours of pay a paycheck for 5 pay periods without written authorization.

40 hours of pay seems like a time to talk about it and record results rather than get an attorney, IMO. Unless there are other nefarious details…

Contact the state wage and hour division... or whatever agency handles employment related claims. I've found them to be on employers like stink on...

But for 8 hours? I've usually "used" them at the end of an employment run. You know... aggregate the hours at the end.

Likely some will suggest not upsetting the apple cart. You know... the future blah, blah, blah. I say never, ever, leave money on the table. Good luck.

Is it in a form of a deduction, or are they legit leaving off hours? If deduction, I'd be sure there wasn't a blanket authorization signed during new hire paperwork.

If in Texas, contact the Texas Workforce Commission.

I had to do this when a previous employer refused to pay me after I quit. TWC did all the work for me and I didn't have to pay an attorney. Employer "saw the light" and I had a check a couple weeks later.
