ANY excuse works. It just can't be a pretext (i.e. false).

They will not get a Batson claim for tossing educators that also coincidentally happen to be black.

I'm growing weary of Megyn Kelly, but listened to some of her coverage as I was in Canada when the case was wrapping up so it made good road trip time on her podcast. She went into detail on Batson.

Obviously "they're black and I think they aren't being truthful about objectivity" isn't a valid reason to strike. She said any good attorney knows how to ask additional and follow-up questions until they get the answer that IS a valid and legal reason to strike.

It's payback for what happened to their ancestors.

I had a good friend at my first company back in the 80s... black professional who graduated from Texas. Yep. I have known several blacks in my adult life that held this same perspective when speaking freely whom I otherwise believed to be great people.

Here is my problem. I only get one life to live on this planet and I don't plan on bending the knee to anyone for any reason. I don't have slave owning ancestors but even if I did, so what? No of us were around. History is ugly. Grow up.

Bigger still is that I am a dad and I will never, ever, stand back and allow anyone to put the their boots on my boy's necks. Hundreds of thousands died to end it. My kids aren't going to be thrown on the pile to appease past grievances.

Probably not on the direct appeal. Unless the new attorneys file a motion for new trial in the trial court, I don't think the COA can hear it. Shook, et.al. aren't going to raise it. They have 30 days to file an MNT but the trial court record may not be available by then.

They'll likely file a writ of habeas corpus and raise it there. Others will have to chime in on this.

They feel his rights were violated because he was convicted and he was black. Supposed to get a pass, be held to lower standards due to his skin color. Might as well throw in a side order of reparations. Bunch of racists wanting him to not be held accountable.
