My dad was a Col in the Air Force. Early in my life, we watched on TV someone burning the flag. He told me that he risked his life for that ****wad's right to burn the flag.

I'm not seeing how the act of burning a flag could incite a riot. Courts have said it's expressive conduct. For example, if you start burning a flag and yell out "Go kill that Jew!", the yelling "Go kill that Jew!" is the inciting act, not the burning of the flag.

Firstly, if an accelerant is used to burn the flag, IF someone is harmed by said burning, is that not a potential criminal act involving arson (civil liability notwithstanding); does the presence of an accelerant not make the seemingly protected display unreasonably dangerous given the confined & close proximity of on-lookers?

Also, I know for insurance fraud claims involving arson, a defendant catches several federal charges including endangering the firemen who respond to the fire regardless of the actual risk of harm presented by the fire's size or intensity. Therefore, how is flag burning different, especially when the exercise of a seemingly protected expression is meant to incite an already agitated mob, which heightens & adds to the risks a fireman would confront if they responded to extinguish the burning flag?

Further, insurance fraud claims due to arson mostly involve money/ consideration being paid to the arsonist to commit the criminal act; many of the "protestors" who burn American flags at these events are PAID AGITATORS. That could be an important distinction that might warrant a lesser degree of govt'l scrutiny to support such a prohibition.

Therefore, I think it is an interesting set of circumstances that MIGHT require a different perspective than what we customarily consider about the 1st Amendment- especially the aspect of 'Mobs for 'Rent'; this isn't "freedom of expression" by an individual pursuant to the First Amendment, but rather a potentially criminal act (arson) performed by paid agents for the purpose of incitement whereby the act itself creates additional risks to mob participants & public officials responding to a location where this is occuring.

Remember, exercise of individual liberties CANNOT create nor heighten the risks of a potentially dangerous or harmful situation to others, & "speech" (which can be a physical act- not just spoken words) CANNOT incite others to act in a dangerous/ reckless manner, such as the yelling 'Fire' in an auditorium example. Lastly, if the exercise of a protected right causes actual harm, the person is culpable; so, if you burn a flag & that fire spreads to a structure that burns down, the person can't claim that "freedom of expression" prevents their prosecution.

The imposition of power is important at this point. Why?
Because left gets it and that is what they care about.

While on one level I think you should be able to burn anything that is yours..... including a flag.... I understand that we are now in an age where symbols and symbolism matter immensely and creates and/or stifles social and political momentum. The left imposes that you may not so much as put a bike skid mark on a gay striped crosswalk..... Given that this is the case.... I find no problem with banning US flag burning.

We must crush the left NOW and as quickly as possible through all legislative and executive means available.

In general, I understand this sentiment. But I don't agree with it. I personally would have no problem with someone getting punched in the face for trying to do it, but let them be an idiot.

But, I also don't like it when people who burn LGBTQ flags or burn rubber over a rainbow drawing on the road get a charged with hate crimes either. It has to be consistent.

Only defense I'd offer is that a lot of our state research institutions (like UTSW etc) would be functionally shut down without Chinese grad/post-doctoral students overnight. I don't want that, even though it's an obvious risk/threat to rely on them long term.

Love this video, thank you for sharing. Sometimes we can lose ourself in the semantics of the flag when its shown being burned on social media. At the end of the day, its just a piece of cloth, it doesn't represent who we are as Americans. Burn the flag and another one will take its place. Burn the capital and the ideas of our founding father's will still live on in every Americans heart. To me, they are just a building and a piece of cloth.

People are being arrested and charged with hate crimes for burning pride flags that don't belong to them and leaving skid market on rainbow crosswalks that are public property. You can argue whether municipalities should be painting rainbows in crosswalks. But it's their property. You mess it up, you're going to pay.

Buy and burn all the LGBTQLMNOP flags you want. Burn someone's flag that doesn't belong to you, now we have a problem.

A simple google search proves you wrong.

Then cite your source. Don't play hide the football.

It was classified as a hate crime. Stealing a flag is petty theft.

And burning it was arson.


No intent to injure. No dwelling. No value. Not arson other than being a hate crime.

True story time. I had just moved to Austin after my first husband's and only brother's death. Bought a house in Great Hills and a large number of my neighbors were retired IBMers who socialized together often. I was invited to a cookout next door. Neighbors knew I was an attorney and the SCOTUS decision about the flag had been handed down recently. These folks were incensed and of course started asking me questions about it.

They didn't like my answers at all as I went back to the Skokie, Illinois Nazi decision on first amendment and free speech. They assumed I was equating the US with Nazis until I explained that first amendment cases had a lot in common and this decision about the flag was consistent with that constitutional analysis. Did I like the decision? Hell, no. But it was consistent and followed first amendment case law and precedent.

I seriously doubt that the long line of first amendment cases on political speech will be rejected over this EO.
