The "T" in TPS stands for "temporary." It's 18 months. The judge didn't say Noem/HHS had no power to deport them, just didn't follow the process prescribed by Congress. Another example of something being on Congress, IMO not the judge. Unlike some other federal rulings, to me at least this doesn't seem like judicial overreach.

Because Congress gets to pass laws. The executive has to follow those laws. Congress mandates how the people can be removed, not the executive branch. The judge didn't make up new law here, the administration did.

Complain to Congress.

This judge is a nut. He's attempting to alter the law as he distorts the statute with his interpretation:

The Statue's Language:
Such termination is effective in accordance with subsection (d)(3), but shall not be effective earlier than 60 days after the date the notice is published or, if later, the expiration of the most recent previous extension under subparagraph (C).

The Judge's interpretation in his Order:
The Secretary of Homeland Security may not publish a termination of a TPS designation that becomes effective before 60 days after the publication of notice in the Federal Register, or "the expiration of the most recent previous extension," whichever is later. 8 U.S.C. 1254a(b)(3)(B). In other words, Secretary Noem cannot reconsider Haiti's TPS designation in a way that takes effect before February 3, 2026, the expiration of the most recent previous extension.

So the statute specifically lays out the timeline that the termination is not effective before 60 days after the date notice is published, OR the end of the initial extension (Feb of 26).

But this judge is twisting the words to replace "if later" with "whichever is later" to state that the initial 18 month extension is a guarantee that insulates any decision by the Secretary to AT LEAST the initial extension date. That's not at all what the statute says.

My reading of the statue clearly states that the Secretary cannot enforce termination of TPS designation BEFORE 60 days after publication of notice. But the Secretary has the OPTION to make termination effective all the way up to the expiration of the most recent previous extension. It's a window, not a guarantee! Otherwise, if the Secretary never posts termination, the TPS designation is automatically extended for another 6 months.

Something tells me these DC District judges got together and determined that they would do whatever it takes to hamstring this administration, SCOTUS be dammed.

This is what I have been screaming for.

When do the Congressional and Senate inquiries begin? Why is Mayorkas not front and center? The democrat party must be made to explain to the American people why they facilitated this, because they did.

On who's order did we ship in millions of Haitians, Venezuelans, Cubans, Columbians, etc.? Why were hundreds of thousands from Iran, China, Pakistan, allowed to enter?
