Yes. But they are diverting some water already.
And more than that they are stopping and releasing it as they please without informing Pak like they used to. So lower areas are flooding and destroying crops.

The 1960 Indus Waters Treaty (IWT) survived two wars between the nuclear rivals and was seen as an example of trans-boundary water management.
The suspension is among several steps India has taken against Pakistan, accusing it of backing cross-border terrorism - a charge Islamabad flatly denies. It has also hit back with reciprocal measures against Delhi, and said stopping water flow "will be considered as an Act of War".
The treaty allocated the three eastern rivers the Ravi, Beas and Sutlej of the Indus basin to India, while 80% of the three western ones the Indus, Jhelum and Chenab to Pakistan.

I know. But the agreement is an old one, about 80 years.
I read up on this as I love history. India's first Prime Minister Nehru in 1947 was very woke. And he loved to virtue-signal. And he had "Hindu Guilt" and "Hindu man's burden", which are equivalent to the issues white men have today. So he thought it was his job to keep the Pakis comfy.
So when Pakistan split off from India, they came to the table to discuss how to split up the waters of all the rivers. India was the upper country and Pak lower. Some 5-6 rivers. India ended up giving Pak 70% of the water and keeping only 30% even though India was more than double the size of Pak. Back then I guess it was a thing to let go and give in.
80 years later, it seems like foolishness. Modi took the chance to suspend it so now that does not apply. If Pak wants a plan, they have to renegotiate and Modi will surely squeeze their Arabic balls.
