Said this on this on the commutation thread... every state that still has the death penalty, for those that received a biden commutation, there needs to be a state-level capital murder trial for murder(s) occurred in the state... if these murderers are found guilty (again) and sentenced to execution, there's no federal commutation that would be available.

Ken Paxton... do your thing.

Not sure if someone else beat me to it, but I imagine double jeopardy laws prevent this from going forward.

It has been shown that the death penalty does not deter crime and with our criminal system the death sentence and the appeals at taxpayer cost is not effective. Life without parole is much better
How can you, or anyone, measure how much crime has been deterred by the death penalty? Kind of an absolute statement with no support. Hasn't deterred a single crime? You have no idea how many people have not committed a crime for fear of being put to death.

Having said that, the death penalty is a punishment for a crime or crimes committed. The cost is only an issue because they don't put these animals down as rapidly as they should.

You liberals seem to care more about the criminal than you do about the victim. You must have some fear of being executed.

Sure does cut the hell out of the recidivism rate, however. And just because they are in prison for life doesn't mean they will not commit crimes while incarcerated.

It's heavily studied, it's just behavioral science. One way to do it is you look at crime rates and what not across different jurisdictions with and without the death penalty and account for other variables, etc. Some studies have come out the other way to some extent, but most don't find a deterrent effect.

Whether criminal laws exist or should exist to deter, to punish, or some combination thereof is a philosophical question as old as criminal laws themselves.
