And of course, the article uses a picture of Neely from 15 years ago. Why is a mugshot never used?

Can questions like this be asked during a deposition to avoid an actual trial if in fact he was an absent father?

It shouldn't even be a legal option to use civil system as retribution in a self defense case.

If you are cleared of criminal wrongdoing then the other party needs to pound sand.

In Penny's case, Neely's actions were an overwhelming contributor to his own demise.

Neely was in foster care until he was 21 after his mother was murdered by a boyfriend at age 14.

Nice to see dad finally show up looking for a ghetto lottery payoff after being nonexistent while his son was alive.

Terrible idea. Tons of people with legitimate suits will be discouraged because filing would come with way too much risk.

We essentially already have "loser pays" in Texas and at the federal level. See Offer of Judgment. It's just that civil defendants rarely choose to invoke it based on risk vs. reward.

So his lawyer figured out that Penny has money? Insurance?

Penny should be able to sue that Dad for the negligent manner in which the perp was raised that caused him to become a public nuisance.

Making parents responsible is only enforced when the offender is white and is the culprit of a mass shooting. No other parents are culpable for their children's actions.

Good luck finding an attorney to take the case. Attorney is skimming 40% off any winnings. Combine with what he sees as a possible notoriety/name bump. He's got time to lose right now and nothing more.

I'm all for loser pays! It would definitely cut down on lots of frivolous claims!

But you have to understand it would also make people never file lot of legitimate claims also!

Taking another hot topic this week: insurance claim denial.

People are going to be less likely to sue UHC if they may potentially owe the medical bills PLUS a couple hundred thousand in attorney's fees!!

File suit against the dad for being negligent. His son assaulted people. Penny had to risk his own life to keep his son from assaulting or killing more people. Not to mention all of Penny's legal fees just to defend himself because of his son. What a loser

Civil AND criminal acquittals should trigger a follow on hearing as to whether the aggressing party was acting reasonably. This should include allow for an airing of grievances to either judge or jury & a determination of whether the justice system was misused & guilty DAs / Claimants could be subjected to penalties corresponding to what they were seeking.

They literally gave him the gun knowing he had violent tendencies and his mom left him at school when they asked her to take him home because he drew pictures of killing other kids with it. I mean she couldn't miss work to take her homicidal kid home, but she never had a problem skipping out to **** her sidepiece.

Yeah, they should be liable and responsible no matter what color they are. At least Neely's dad can say, "I wasn't around until he was dead."

Absolutely!

But seriously - all of the political bs that the jury gets shielded for like campaigning on asymmetric prosecution or absentee father status should be fair game when assessing whether the motives to bring the case were reasonable or not.

A case can fail to meet the threshold of conviction without being ill conceived, so I agree it shouldn't be an automatic "loser pays" system… but the threat of a jury reverse uno'ing the charges on you would cause folks to second guess the arithmetic of bringing a frivolous charge court.

Also, if I were Neely's Dad I'd seize upon the testimony that Neely was still alive when the cops got there and go after the city's much deeper pockets.
