While I agree that wasting judicial resources should be every judge's concern but this is a first for a DC judge when it comes to Jan 6th prisoners. So, is this just a fig leaf excuse?

By that I mean deep down, Nichols knows these prosecutions are not justice?

Gonna save those resources now, but they spent like crazy trying to get Trump and some of his supporters. I hope they find laws broken by these DOJ scum lawyers….all the way to Merrick Garland. This time lock them up.

DC cocktail circuit.

I have been critical of most of these cases on the basis that the charges are very weak sauce that few prosecutors outside of DC would prosecute, much less advocate no bail on the basis that grandma was a threat to society. Very disgraceful and a large stain upon the DOJ and the federal judiciary in DC.

There are still people being held after the SCOTUS Fischer decision throwing out the 1512(c) charges as a massive misapplication of that Sarbanes-Oxley statute.

Because he's charged with swinging a bat at law enforcement.

This judge does not think there is an injustice here. He's against blanket pardons for everyone related to J6. Should be noted, Trump also against pardons for violent offenders.

What is the recourse for a civilian against these a-holes in DC doing this to them? Are they immune to personal punishments of any kind? (I am honestly asking the question btw, I know nothing)

It was mentioned, but how in the hell is Congress not holding hearings on the judicial abuse of these people? Absolutely ridiculous. A pardon of course is expected, but IMO that is not nearly enough.

The request was made by the defendant Lang, not by prosecutors.

Judge Nichols asked if the Government could assure him this would not be a waste of government resources given the pardon possibility. The Government said they could not make that assurance.

Nichols then said to set a trial date between 1/27/25 and mid-March. Government sent notice for 1/27 trial. .

No. He's had requests for delays in sentencing because the defendants believe Trump will pardon them. He's denied those.

I don't for a second think any Dem or TDS-sufferer has turned the tide regarding J6. They sincerely think it was a legitimate attempt at an 'insurrection.' POSSIBLY deep deep deep down they realize it is a travesty of justice (except in possibly a very few cases), but not likely. These people believed russia russia russia, have multiple boosters, etc. etc. - they are not rational or reasonable people.

EDIT: thanks BMX for adding some info. apparently this judge has been reasonable in the past and not appearing to turn any figleaf.

Nichols was the only district judge to say Government was misusing 1512(c). SCOTUS agreed with him in Fischer.

Buts he's a POS to some I guess.
