The execution of Robert Roberson -- whose "shaken baby syndrome" murder conviction in the death of his 2-year-old daughter has come under scrutiny -- can resume, according to a Texas Supreme Court decision Friday.

Texas Attorney General Ken Paxton and other state officials have argued that "Roberson was lawfully sentenced to death" and that he has "exhausted every legally available appellate avenue."

From the little I read, if wasn't SBS it was neglecting a sick baby at best.

There are lots of attempts to paint him as innocent of everything. When they do that, they are lying to you. They are basically throwing everything at the wall and hoping that people are stupid enough to believe their defenses.

The medical examiners did a full and careful autopsy and ruled the cause of death as being blunt force trauma. You do not cause blunt force trauma by shaking a baby or by the baby being ill.

It appears that the shaken baby syndrome in the trial was from the defense trying to use that to say that Roberson was shaking the baby and could not have known that it would result in death. While the medical examiner could not rule out that he shook the baby, she found that the cause of death was blunt force trauma.

The evidence presented at trial was that the death was caused by blunt force trauma as a result of him beating the child. Shaken baby syndrome was presented but it wasn't at the very forefront of the prosecution's case. The debate here is whether he should have been granted a new trial without the shaken baby evidence in light of the fact some of that testimony is no longer consistent with current best scientific evidence. A state witness also slipped in some prejudicial testimony about an alleged sexual assault of the child that was not backed by evidence.

His supporters still maintain the trauma to the child's head could have been caused by physiological fall rather than him striking the child. The legislative committee at least heard some evidence consistent with this theory but frankly I think the guy probably did it.

I'm still not a fan of the death penalty frim a practical standpoint as it costs resources, does not seem to be an actual deterrent to prevent crime, and life in prison without parole would be considered by many to be a worse punishment.

I would think that the probability of a baby dying after falling off bed would be pretty low. If it did happen, the baby likely wouldn't be alive to pick up and put back in bed as he claimed.

Everyone is always looking for the next West Memphis 3 type of situation. They want to find someone who is rotting in jail with multiple appeals, then look for any holes they can run with. The WM3 trial was an absolute abomination. It was very clear that they were innocent, from the start. A corrupt town and police force just covered it all up and made them scapegoats. Even then, it took 18 years to have them exonerated.

This case isn't even close to that one. Nothing really paints the picture of innocence. This guy was just a sick, irresponsible "parent" that got caught. May he enjoy his trip to hell.

That's true except ee was a lot more than just sick and irresponsible. He was quite violent. Whipping his baby daughter. Putting her in a red ant bed. Sexually molesting her. Beating the hell out of her.

I knew a guy who was executed by the state, Curtis Harris (he murdered an Aggie), and Roberson makes him look good in comparison.

Shaken baby syndrome has nothing to do with the fact that he beat the **** out of this baby over a period of time. Sorry, but Roberts will get what is coming to him.

It wasn't neglect or SBS. It was extreme child abuse from what I have seen

The evidence seemed pretty clear cut and the claims of the defense that it was just small town, incompetent heathcare and law enforcement professionals were untrue. Seems like a lot of lying from the side claiming to be for truth and justice. I'm not sire why thos keeps coming back up.

It kind of makes it unlikely that some one won't show up and muddy the waters to get him released, thus helping to protect the public.

Also, it is theoretically a pretty good deterrent to others.

The sexual molestation allegations appear to be nothing more than for public consumption. There's no evidence for it other than a jailhouse snitch. No evidence at trial from the doctors or the medical examiner. Advocates for executing him like Ken Paxton throw it out there to inflame the passions of the public.

He had taken her to the hospital multiple times over a few days due to a lung infection. The hospital didn't see injuries on her to the point of being concerned about child abuse the first few times he brought her there.

I have a hard time thinking he's innocent of the murder, but still just more concerned about the process.

While he wasn't convicted for the sexual molestation, it goes a lot into showing what kind of man he is. Everything else seems to show that anyway, the sexual molestation allegations just push it a little more. Take out those allegations and what is left clearly shows him to be a very mean and evil man.

The medical examiner noted that she had macro****es and neutrophils in her lungs. Those are, I think, there to help repair tissue injuries, but that doesn't mean that she had pneumonia.

One thing that makes me wonder is whether the baby's lung problems might have been due to someone around her smoking. Did Roberson smoke? If he did, I wonder if that would explain her lung issues.

In any event, the medical examiner did examine the lungs and did not find lung disease/pneumonia to be the cause of death.

It seems to me that most of the issues are being created by those doing everything they can to muddy up the water in hopes freeing him from prison. I really don't believe their claims without some kind of proof and they haven't been able to provide that. Their whole defense of him seems to be devoid of evidence.
