The guy asking the question didn't seem like a liberal nut job. It's a good question and allowed him to flesh out the coming changes.

My only question is what happens to all the kids/students who have disabilities that fall under IDEA - Individuals with Disabilities Education Act. There current laws that the DOE at the Federal level make sure these students are taken care of.

When I was in elementary school in the 60s, this was a large bone of contention. So much so I remember seeing a film about a federal takeover of education in class. Many many states wanted to retain local control and not cede that authority under the Tenth Amendment (not that I knew what that meant at the time)

My opinion (not a lawyer) would the laws passed by congress remain, but the regulations issued by the DOE go away.

I am all for shutting down the DOE, but wouldn't that take congressional action? I don't see any way in the world that there enough votes in the House and possibly not the Senate to allow for that to happen.

This is where DeSantis was less bullish on shutting down departments as a whole. You're right in saying it isn't easy to do. The question is how much of it can be cut and how much control and money can simply stay with the states to begin with.

That's the thing: many of them DO NOT get "taken care of" as you put it. My wife has been in special ed her entire career -- 35 years. Roughly half in general spec ed and the other half in deaf ed. I, on the other hand, have represented both Plaintiffs and Defendants (at different times, obviously!!) in education related matters closely related to this issue. So trust me when I say I'm pretty checked out on these things.

Schools often fight like hell when called upon to do stuff for these kids that they don't want to do and that's when they're even paying attention to the kids in the first place. Sure, there are minimum programs in place in a lot of places, but the reality is that if the staff can get away with ignoring as much work toward fulfilling any "special" requirement, they will. My wife is an exception and has worked tirelessly over the years to get kids things like hearing aids through government assistance when other school officials did little to nothing. NOTE: it wasn't HER job, at least initially, to do that. The kid's case manager, counselor, or another staff person dropped the ball.

There's absolutely NO evidence that these things couldn't be handled far better at the state and local level. If we didn't send so damn (I'd rather use harsher language) much money to Washington, we'd have a lot left over for State and local funds.

I presume that since the DOE is part of the executive branch of government, the President has control. He may not be able to eliminate it, but he should be able to change it and basically make it only a shell of what it once was. Remove it's power. Fire its staff.

After No Child Left Behind, the federal government got some permanent teeth into the state's education system.

That garbage bill was put through by George W's wife Laura, as I believe it was her brain child. Absolutely should have been scrapped being unconstitutional at the start.

If a voucher is provided by any sort of government, be it local, state, or federal, I am against it.

Sounds great in theory, but you allow government to fund anything, you're giving them an opportunity to assert control. Government should not determine what a private Christian academy does, and government provided vouchers give them an in road to do that.

I think you mean the No Child Left AHEAD bill. It was as appropriately named as the Inflation Increase Act under Biden.

I disagree. To ask that question a person would have to believe that the Department of Education serves a purpose and fulfills a mission. As Knowles points out, the DoE has an uninterrupted ~45 year history of failing at its stated mission. The guy asking the question did not know that.

The second part of the question is bizarre. I can't imagine any parents of school aged children that would know of anything that the DoE provides to their children except for subsidized meals. That's really the only function of the DoE and meal subsidies are used as a lever to compelling local school districts to teach federal curriculum and to put teachers unions ahead of students and parents.

I would love to tell the DoE staff that they are now free to return to their passion and teach children in the classrooms of the DC public schools. That would be delicious.
