I hope he wins. They will claim its standard practice to edit interviews but this was fabricating an answer to deceive the voting public. Election interference and essentially an in kind contribution to her campaign.

Had Trump sat down with them, they'd no doubt done the same thing to him only in the opposite direction.

The major networks in this country need a massive come uppance to force their political reporting back to the middle. The Norah O'Donnell segment on Trump's garbage truck moment was insanely biased.

Wouldn't this have been better had it been done over three weeks ago when the interview was done? Four days from the election doesn't seem like it'll have much of an effect on the election.

"Trump isn't Congress" means nothing in this context. It's whether or not CBS has a defense under the first amendment.

I have not read the complaint, but it should be noted that the first amendment is not a de facto "get out of jail free" card for deceptive trade practices

Their biased broadcast from yesterday, when they called his garbage truck a stunt and praised Kamala for being above the fray, was the linch pin they needed.

Also, it is not about the election, it is about bringing down the State's media.

This complaint will get tossed. They might be able to amend and survive, but the complaint as written does not identify how he was harmed in his capacity as a consumer of CBS's services. For example, how did the deceptive editing deny him the value of the services he sought from CBS.

The question posed is whether the first amendment applies. Is Trump the Us Government trying to quash free speech? If not, the first doesn't apply. I've never understood why this is such a hard concept for people to grasp.

Whatever this lawsuit is, it's not a Deceptive Trade Practices Act lawsuit as some of you are saying. That's a state statute to protect individual consumers and small businesses from product defects and bad services.

I would have preferred if he would have not done this, because this falls in line with, not in my opinion, but it will be framed how Trump will govern, as the Dems have said he will, going after his enemies.

The Harris campaign explicitly said the first amendment shouldn't apply to "hate speech" or "misinformation".

Isn't CBS changing a Presidential candidates answer, in post-production, the definition of "misinformation"?

And they will get a chance to argue that in front of the judicial branch of our government. But it's so frustrating that they hide behind absolute immunity and cite the first amendment while trying to justify the erosion of the rights of Americans that we are guaranteed. Like the second amendment

The problem for Trump will be proving some kind of actual damage from the interview. There is no question that CBS saying "We are interviewing the Vice President and giving you the answers" and then giving you answers that she did not say in response to a specific question, and using it to make money by selling advertising during the show is deceptive and fraudulent. But I don't think Trump can demonstrate actual damage unless he can say that their deceptive and fraudulent actions turned the interview into a free campaign advertisement.

He doesn't care about the damages. It is about de-legitimizing CBS.

Good question and point taken.

The first protects you from the government censoring your speech. You are afforded no protection from a private citizen or non-governmental company censoring your speech.

It can get ugly at times, but that is the price of free speech.
