Quote:

A central Arkansas father has been charged with first-degree murder after finding his missing underage daughter in the car with a man, then shooting and killing the man.

Quote:

The man who was shot, Fosler, had been arrested by another agency in July and booked for internet stalking of a child and sexual assault, Sheriff Staley told USA TODAY Friday afternoon.

My personal thoughts are that the legal process should have stopped with "Oh you shot a known child stalker who had your missing 14 year old with him?"

The good people of Arkansas should hand him a pile of cash and acquittal for saving them money on prison for this *******. That's all.

Yeah, this dead guy was clearly stalking this young girl as well as others, and it says she was the only witness to some of his other charges. Her dad believed either she was next to be molested or that her life was in danger and he was protecting his daughter.

Who knows what the prosecutor will do but it sounds like the sheriff is fairly sympathetic to the dad's situation.

IMO, this dad should get a trophy and a nice reward for finding and dispatching this predator.

So if I'm reading this correctly, the dead guy was a former police chief from out of state.

The man arrested for his killing has not been formally charged with anything. He was arrested under the suspicion of first-degree murder but that's not been charged by the prosecutor as of yet.

The shooter is claiming the dead guy was going to kill his daughter. Dead guy had a no contact order with the girl and when she went missing dad apparently sprang into action.

OMG. This guy raped their daughter and was still a free man. Here is what the wife of the man who killed this creep posted:

"Our family has been through the unimaginable. Over the last several months we have been living this nightmare privately. That all changed this week when our life turned upside down and a culmination of all our first fears was realized.

In spring/summer 2024 our then 13 year old child was targeted, groomed and ultimately raped by the boyfriend of a family friend. Our family did not know this monster. He just appeared in a place where our child should have been safe and got access to her phone number. And that's all it took.

We let the justice system do its job. The monster who hurt our child was charged quickly, but released even faster on a $50k bond. He was awaiting court in December for several felonies in relation to what he did to our child.

In the early morning hours on Tuesday, October 8th, 2024, we awoke to our daughter's dog barking. This is unusual and caused us to check on her. In that moment we lived every parents biggest fear as we realized our teen child was missing.

We frantically searched our home/property and started calling friends, family, and 911. My husband immediately got into his truck to go blindly searching for our child.

By God's never failing grace, my husband passed this man driving on our road with our minor child in the vehicle. As soon as the predator knew my husband was behind him, he ran. The chase ended in an accident. Aaron was able to retrieve our child alive, but in the process he was attacked and did what he had to do to protect himself and our minor child. He is now facing an outrageous murder 1 charge.

We were able to bring him home on $150k bond, but now we need to retain a legal team. I'm starting this campaign with a goal of $50k but I understand now it will likely cost much more.

My husband is a combat veteran, who has always protected his country and family. I have no doubt our child would have not come home if my husband hadn't found her. Please help us keep him home with us where he belongs. Any donation is appreciated, but we will also take all the prayers we can get."

And according to he mother, the dead guy was out of bond after being charged with raping their daughter.

With this fact, I went from "Give him the absolute minimum the law will allow" to "Meh, guy got what he deserved and dad goes completely free."

Mind you the scum that raped his daughter got a $50K bond and the hero dad gets a $150K bond. Granted two different crimes charged but that is just ****ed up on its face.

Hopefully the good folks of Arkansas on that jury if it gets that far will send this man home to his family.

Devil's advocate: The guy he shot wasn't convicted of anything yet. However, since his daughter was in the car at the time there was a "crime in progress" so probably ok in my book.

DA's office will likely convene a grand jury and he will be no-billed by the grand jury, is my prediction.

I don't understand the sheriff's actions/statements. You don't have to arrest anyone for anything until the investigation is complete.

Agree.

The girl was 13-14 while all of this had been goingon for several months. Deceased was 60.

Dog was barking suggesting the deceased had been at the home, violating the no contact order. There was a chase, car wreck and then an altercation between the two men.

Not a perfect case of self defense, raher an imperfect one but the facts here are egregious enough no grand jury would indict, not on a first degree charge at least.

The good folks of Lonoke County will never convict the father. That's good ol' boy territory. Full of farmers, country folks and blue-collar workers. People can trash talk my state all they want...with the incest jokes and toothless redneck talk...but one thing's for sure, we'll protect our families at all costs. Real recognize real around here. He may have to endure courtrooms, lawyers and judges, but he won't see any prison time. Not here.

Optics. Sometimes just have to have some faith.

Hey buddy, going to place you under arrest <wink, wink>, and take you in for questioning <slight squeeze of the arm>, and we'll have to do our investigation and get this sorted out <reassuring eye contact and slight smile>

It's Arkansas. And I say that as a good thing.

Couldn't agree more. Arkansas is a beautiful state with some really fun towns and great people. At one point my oldest was seriously considering going to Arkansas and I supported it 100% but he's a fish at A&M.

I had to drive up to Hope, AR, for a funeral back in 2019.

There were at least 100 people there and I was one of three men wearing suits. I am pretty sure the other two worked for the funeral service company. I felt like such a tool. Oh look, the guy from Austin shows up in a suit and tie. <sigh>

The pallbearers wore Wranglers, white western shirts, and white Resistols. They looked slick. I ditched the suit as soon as I could.

Should have shot him in Texas. This is kidnap or sexual assault.

9.32(a)(2)(B) deadly force is justified:

(B) to prevent the other's imminent commission of aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery.

How did the girl get out of the house and into the vehicle? Did the dead guy enter the home or was the girl brainwashed into "loving" the dead guy and snuck out? She obviously didn't suddenly appear in the vehicle.

Asking for understanding nothing more.

In increase in the failure of the judicial system will lead to an increase in vigilantism. It is simple human nature that if the state won't provide justice, you are more likely to be obligated to carry it out yourself.

Sounds great but eventually these things get out of control and you end up with the Salem witch trials.

Do I believe the moms version of the incident that led to the rapists' death? Not really. But do I care that it's likely fabricated and may not be supported by evidence? Not really.

Not guilty.

And fire the DA.

Prayers for that family. Will never be the same after that pile of sh** came into their lives.

Not self defense but defense of another and in this case a minorr child

Some states don't recognize defense of others as a justified homicide. See Daniel Penny in NYC the subway guy.

Any chance the reason the DA is bringing 1st Degree charges is because he knows it won't go through? But then everyone can say they followed the process and no one gets blamed for favoritism or anything?

My understanding as of this moment, no formal charging has yet occurred nor a grand jury convened nor assigned if recently convened for other matters.

That having been said, it is not unheard of for a DA to overcharge to get a no bill. DAs have unfettered control over grand jury proceedings. They can present what they want to present to shape the presentation to them. There is a supervising judge but they largely rubberstamp if a grand jury wants to issue subpoenas, etc.
