Hope it was a legal shot and the perp really did fire on cops first, but the story is kinda strange.

Case closed.

Couple had just moved in to apartment, they come back and garage won't open, they call maintenance to open the garage, they open the door and the perps car is in the garage. He stole clothes and a TV. He ran away on foot and made it a couple blocks and then hid on a street. Cops show up and he supposedly fired shots and then gets vented. Nothing was released by the Frisco PD for more than 24hrs except that TX Rangers were leading the investigation. Any more questions?

The apartment complex (likely Legends at Legacy) is on the east side of Legacy Dr and the perp fled across Legacy into the residential neighborhood where he was spotted, fired at the cops and was killed.

Rent at that complex still starts at $1500 for 1 br/ba

Or don't do stupid crap that has a tendency to put you in close contact with law enforcement even if you are stupid.........criminals get what they deserve for being criminals. Bet that burglary wasn't his first either.

Texas 9.42 might say otherwise.

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41; and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property;

Yes, it should. And don't you dare equate jaywalking to breaking into someone's home.

You don't know if the burglar has a gun or an intent to do you bodily harm. The simple fact they have broken into someone's residence should be considered an assault.

If you don't want to end up dead, don't break into someone's home. It's a pretty simple concept. And guess what? We no longer have to worry about this person being a threat to another human being ever again. I say that's a big ol WIN.

I like Utah's statute which says deadly force is authorized in a burglary regardless of whether entry was made tumultuously or surreptitiously:
"76-2-405. Force in defense of habitation.
(1) A person is justified in using force against another when and to the extent that he reasonably believes that the force is necessary to prevent or terminate the other's unlawful entry into or attack upon his habitation; however, he is justified in the use of force which is intended or likely to cause death or serious bodily injury only if:
(a) the entry is made or attempted in a violent and tumultuous manner, surreptitiously, or by stealth, and he reasonably believes that the entry is attempted or made for the purpose of assaulting or offering personal violence to any person, dwelling, or being in the habitation and he reasonably believes that the force is necessary to prevent the assault or offer of personal violence; or
(b) he reasonably believes that the entry is made or attempted for the purpose of committing a felony in the habitation and that the force is necessary to prevent the commission of the felony."

I don't see any reason for a line, you steal something from someone else, that responsibility is on the thief not the person protecting their property. Jaywalking…are you serious? Wtf is going to enforce that…a bunch of lib Karen's?? Property is a different story though, if it ain't yours don't take it, or if you you do take decide if your life is worth it.

His big mistake was not claiming to be a tenant/squatter. He could've just chilled out in new digs for at least a few weeks before eviction.
