"The NY appellate court's unexplained reduction from $454M to $175M in the bond Trump must post in 10 days to secure the judgment pending appeal is a travesty of justice," wrote retired Harvard Law professor Laurence Tribe. "Let's hope public disgust with this preferential treatment will come back to bite Trump politically."

"NY's justice system," wrote Tristan Snell, a former New York prosecutor who handled the Trump University case. "Appellate judges hand Trump a gift, cut bond down to $175 million, give him 10 extra days; Imagine a basketball team down by 40 points, and with 1:00 left in the game, refs give the losing team 5 more minutes and lower the hoop from 10ft to 6ft."

So much effort, over a month's worth, put into this thread trying to convince everyone the big bond payment was justified and appropriate, just to see it all go poof.

It's telling how several posters were suddenly silent as soon as Hawg posted this on page 25.

"Bond has been reduced to 175 million. Just announced."

That number is a little more fair.
It should be 0.

No crime, no victims.

This is insane.

FWIW, we have lots of laws regarding lying where there "isn't a victim" in the sense y'all are using it.

If you lie on all sorts of documents or you lie in all sorts of settings, it's a crime whether or not someone else is "victimized" by it.

I'd love to watch one of you defend yourself in court by saying "well judge, you/the police/the FBI/the jury/whoever knew I was lying!"

What "documents" are you talking about? Obviously not the ones being discussed here which are evaluations of property values by professional appraisers that follow a clearly stated disclaimer that the party evaluating their value should perform their own due diligence to ensure their accuracy or draft their own judgments.

If I list my home "in documents" for $3.3 million but it's fair market value is $1 million, no crime is committed even if someone is foolish enough to pay $3.3 million for it.

Interesting. So all you have to do to free a crime is to flee the country for some place that won't extradite you and send a change of address to the courts to tell them where you are?

I wonder why Roman Polanski hasn't returned to the US.
Why do you always go to a Swiftian response? Channeling KBJ from the Supreme Court? The time you take to come up with such absurd hypotheticals instead of just informing yourself really is amazing in a bad way.

Why do you always go to an ad hominum response?
ad hominum? I didn't call him another species. LOL.

I see you are unfamiliar with the works of Jonathan Swift.

Poor TDS-sufferers in the judicial systems have made Trump another fortune (or rather, will imminently) via Truth Social. Hopefully he gets these verdicts fully reversed/overturned on appeals to actual adults.

An appraisal is an opinion

The value of a building is an opinion

A difference of opinion in a building valuation is not a lie. As long as both sides can present evidence and support their opinion there should be no issue.

That's not what happened here. In this case, the value of a building was based on a size three times bigger than it actually was, and zoning restrictions and other restrictions and covenants were ignored. When you start doing stuff like that, the value opinion isn't reliable.

But the banks still offered the loans.

Actually, what made Trump another fortune is Big Tech's attempt to censure him and keep him off their platforms. In the end, all it really did was make Trump more powerful and wealthier.

Does calling it "disgorgement" instead of a "fine" really change the substance of what is happening? Strikes me as mere semantics.
Not really. Disgorgement typically means giving up something obtained unlawfully. There was no damage here. Heck, there was no misrepresentation, let alone fraud here. Trump's team placed a value on collateral. That value was disclaimed and the lenders (of course) did their own appraisal. Their loan terms were based on THEIR view of the values in question.

This whole case is a fraud.

I take my oath as a lawyer seriously. It really pains me to see so much unethical conduct by judges and prosecutors here.
Fully agree with you. This is beyond appalling not just the ruling but the way the trial was conducted was a mockery.
But it's not that surprising. Engoron is a full blue blooded Democrat. Has been for a long time.

And pretty much the entire party is on a path that discounts the foundational prinicples this country was founded upon:
  • Judeo-Christian Values
  • Freedom of Religion
  • Equal Justice under the law
  • Value of Life
  • A civics minded population
  • Constitutional interpretation of the law
  • An objective press with fidelity to truth rather than a party

All of these, which have been argued to some extent over the past decades, are now bascially thrown on the trash heap for sake of short term objectives.

Engoron is not the source of the problem. He's the result.

Seems to me this is a court clerk decision. The running joke among trial attorneys is that there is no appeal from clerk of the court law. What they say usually goes and you have to do what they want you to do before acceptance of a filing.

Are they asking for a personal financial statement of Trump or the company providing the bond? Why would they care what his personal financial statement says with respect to the bond. A companies providing the bond I don't understand this.
