As a father you have to show up at all these places and let everyone know you're paying attention.

In some cases, he/she might be. If John Smith hates you because you stole his wife, and he swears eternal revenge and sends you some kiddie stuff and alerts the cops, they come home and haul your ass to jail, then you are a Receiver and you are innocent.

But if you actively solicit this stuff, pay for it, go around looking for it etc etc, then you are guilty.

If you read the affidavit, it appears the FBI did ask him questions and he admitted to seeking, requesting and willingly accepting, perusing and saving the material. He admitted to joining groups known to send out material and participated in such groups after knowingly receiving CSAM.

To be clear to InfinityAg, this was NOT the scenario they outlined in their example. Though those things can and do happen particularly in the midst of brutal custody battles of minor children.

But again, what only was that not the case here but it appears the FBI even allowed for the perp to provide such defense for having the materials but instead he confessed to knowingly receiving it and seeking it out.

My issue is with the cops. We always hear of them catching someone who received this stuff. Never about catching those who created this stuff. Tells me that they are taking the easy way out.

There are posters on this thread who maybe need to seek help. They seemingly have such hate for law enforcement, perhaps from spending too much time absorbing toxic social media content on that topic, that when they hear of an arrest they immediately blame or criticize law enforcement without (apparently) even bothering to read the affidavit first.

The creators perhaps aren't even in this country. I think the images in question involved Indian and Spanish speaking children from Spain or Latin America.

Honestly was not surprised when this story hit. We are acquainted with the family, but I wouldn't call us friends. For the last few years, he had been publicly liking and retweeting adult porn without any shame. At the time, I remember my wife and me wondering if his wife knew and whether we should tell her. But again, we weren't close. His Twitter went silent early this year and now we know why. I wish I could go back and warn his wife about his social media before he had a chance to do what he did to his daughter and potentially other kids.

It's sad and a shame, but I hope his family can move forward as it is obvious he has some serious issues. He should also never be freed regardless.

1) The receivers create the market for the creators to keep creating. No audience means no reason to create and share. People searching for this stuff are also people who are at high risk for developing an urge to actually abuse a child if they have not done so already.

2) The federal statute for reciept requires proof of intent.

3) I'm pretty sure there's a prioritization process for getting the bigger collectors/traders and creators. If you look at the federal press releases on the Project Safe Childhood page, there are not many small timers on there. The feds have a 95% conviction rate for a reason. They rarely prosecute anyone in which the case could possibly be in doubt.
