Mollie says shame on the advertisers for pulling out. But, if they hadn't, Musk wouldn't have the significant damages he's using to bring suit now. Not that they deserve a medal, but it was a necessary piece of the puzzle to 'out' the criminal activities of MM.

They drew Pittman, which isn't the best judge for X to have assigned to this case. MM will undoubtedly try to get it transferred out to another court, but I don't know how successful that would be. This may just get 12(b)(6)'ed into the sun by Pittman.

there may not be a better judge they could have drawn.

there is no way Pittman dismisses this on a 12(b)(6) motion.

are you confusing him with someone else?

O'Connor or Kacsmaryk would have been better, IMO. Wasn't Pittman the one who enjoined Texas on at least one of their internet censorship cases, or am I thinking of someone else?

on Kacsmaryk, a case filed in the fort worth division would not be assigned to a judge in amarillo.

on O'Connor, i disagree he is better for X than pittman, but i guess people can disagree about that.

pittman is a great draw for musk in this case. not sure really what you are basing your position on.

I hope and pray that one remedy for this is that Media Matters has to pay for corrective advertising based on their false advertising. Technically might be available under Lanham Act, but I'm not sure I have ever seen an analogous case.

I'd love to know how X expects to recover from Eric Hananoki. He's not mentioned anywhere in the Claims section, so it's hard to see how he did anything (yes, I'm aware he's the author of the article. But one would think if you want to hold someone responsible, you'd mention HOW they harmed X. That hasn't been done.)
