Is the Georgia special grand jury the same as the grand jury. Or are they two different bodies? Can the Special Grand Jury actually return a prosecutable indictment? Why is a recommendation for indictment by the special grand jury different from a grand jury indictment, if it is? I am confused. Admire your research and depth of legal knowledge

When Willis requested for a special grand jury, she specified that they would not have the authority to indict, just write a report of their findings and give it to Willis, who retained the authority whether to ever release the report or not, as I understand it.

But then that one special grand juror made the rounds on the cable news networks about their findings, anyway.

Thanks. This is some real light on the subject. So the Special Grand Jury is an imaginary grand jury that the DA cooked up. I was a DA and I guess I could have summoned a bunch of people to the courthouse and told them, "you are a 'special grand jury' and I want you to recommend who all you think should be indicted. Then I will take your recommendations to the actual statutory grand jury that has been lawfully sworn in."

Two different grand juries and she still came up with a POS indictment, in my view. Stretching that Georgia RICO law tighter than a rubber band on a toy airplane or these days, around watermelon.

They're common place across lots of jurisdictions, including at the federal level (18 U.S.C. Chapter 216). And this case is exactly what they're for. A long, complex course of conduct involving a lot of different people.
