Edit- he was just sentenced to 30 years. He was convicted in June.

This trial and now conviction has me a bit concerned. Now granted I did not follow it closely nor do I have or have heard all of the evidence other than what I can read in articles; so take all of that into consideration.

From what I have read, two of the accused were his girlfriend at the time. Both claim they told the scientology church of the rapes but were told not to speak of it nor report it to the police. Neither went to the police until years later, one being during the "me too" movement. Both victims reached out to Masterson after the fact, one trying to get back together with him.

The first trial was hung as they could not reach a verdict. The second trial deliberated for two weeks before reaching a verdict. The main piece of evidence is the word of the victims against Masterson. The second piece of evidence which was barred from being used in the first trial but allowed in the second was the women's claim that they were "drugged." One stating she was completely unconscious and the other saying she felt drunk. No evidence other than the victims word.

He will be sentenced from 30 years to life.

Again, I don't know what happened but it does concern me that a man can be sentenced to basically the rest of his life for a crime that two women say happened 20 years ago. I do hope that the allegations were true and justice is being served because the opposite just sounds terrible and insane to me.

I haven't looked at any details, and I REALLY hope there is more evidence than the women's testimony decades later.

It's a very scary time for young men in general.

Don't get mad at people for not accepting jury decisions as we're watching grandmas get decades for walking into a building and political candidates being sandbagged by the legal system. I have no idea about this case and don't really care.

Take it easy. I admitted my ignorance of the trial. I will point out however that AN AMERICAN JURY couldn't convict him the first time around and 2/3 on the second time. So it's not just me who has doubts.

Besides, a jury is made up of those of your peers who were too damn dumb to figure out a way to get out of jury duty (&/or someone with an agenda), & say this as an attorney of 20+ years practicing law in several jurisdictions.

Plus, a party to litigation routinely appeals a jury's determination, so let's not get all high & mighty here.

I haven't followed the case much either. The scientology angle is interesting. But if a jury found him guilty "beyond a reasonable doubt" what possible evidence could there be so long after the alleged events?

Maybe he's a scumbag rapist, but I'm always going to be skeptical when alleged victims wait 20 years to say something.

Masterson is a Scientology scumbag that deserves far worse than he is getting.

One of these ladies went to the police in 2004, but she was threatened by Scientologist to drop the case. They did give her a payoff of $400,000, but that was under the dress that they were going to declare her a "suppressive person". If you know anything about Scientology, that is where they essentially ruin your life and cut you off from all your family.

One day he will get what he truly deserves.

"Not a Bot" posted this a few months ago as far as the relative guilt or innocence of Masterson:

The three counts were for acts against three different women. Another victim came forward but the DA decided they could not prove the forcible nature of the rape (again, statute of limitations had passed for the crime of the drugging-style rape). She did not testify.

However, another woman who was not a member of Scientology and was from Canada and who did not know the other victims, testified that Masterson drugged and raped her.

There was another alleged victim who testified in the last trial but not this one.

Aaron Smith-Levin, a former Scientology Sea Org member who left the religion years ago, thinks there may be eight or more victims. He says there's one still in Scientology whom he knows of and potentially one more.

He also has made strong allegations on his YouTube channel that one of Danny's friends and fellow Scientology member is a known child predator and one of the victims of Danny was also a victim of this guy when she was young. When she got up to testify this guy moved so he could be directly in her line of vision."

I don't know if he's guilty or not. Didn't seem to be any evidence other than their stories from 20 years ago, which apparently evolved over time. So yeah, i may question a jury's assessment of guilt beyond a reasonable doubt. But if he is a raping scumbag, then good for getting 30 years

Is there no statute of limitations on this? I get murder but something like this with no physical evidence and 20 year old memories is just no bueno for criminal court. Civil I can see.

Given what I have seen of DA's witholding evidence and the general makeup of a jury - most of the time a question or two is absolutely warranted.

And cut the drama llama out - this is a message board, and this is the political section. Last I checked - no thread on any message board ever has magically overturned a jury verdict in some far away (or local) court.

I sat on a grand jury that was brought a he said she said rape case. It was a diverse group of individuals. The men were ready to charge him and let the trial court sort it out. The women especially the moms with boys didn't want to charge him just on the word of the girl. I truly believe that the guy took advantage of a very drunk girl, but I didn't see enough evidence to charge him and have that around his neck for the rest of his life.

It was completely not what I was expecting in terms of how certain demographics would handle the case.

I believe one of the victims filed a police report all the way back in 2004 but Masterson was able to produce enough Scientology members to refute the claim/accusation that the investigation never went anywhere. I don't know if there is any physical evidence but at least one of the victims didn't just wake up one day and decide to accuse Masterson of rape 20 years later.

we all want justice, i'm sure

20 years is just a huge stretch for circumstantial evidence

I find it more likely than not that Scentology worked to quash things in the past, they are beyond slimey


Part of me might want to convict but but yet remain conflicted about the lack of solid evidence

We are suppose to have the highest bar for conviction, too many times I think that ideal isn't upheld

And this cat might be a poor case to point this out, but that doesn't change the burden put on our prosecutors and juries that in my opinion they often fail to meet.

Yes. She filed a police report a year later but to her credit she says she brought it up to the church not long after the fact. The police did not find any credible evidence to charge him though.

This is the closest thing I have found to an immediate report which weighs heavily, imo, have credibility. With that said there is still no evidence, that I have seen, that isn't the word of the victim.
