Blendon Township also sent its use of force policy for the police department. The policy states the following about how officers should respond to a moving vehicle:
"When feasible, officers should take reasonable steps to move out of the path of an approaching vehicle instead of discharging their firearm at the vehicle or any of its occupants. An officer should only discharge a firearm at a moving vehicle or its occupants when the officer reasonably believes there are no other reasonable means available to avert the imminent threat of the vehicle, or if deadly force other than the vehicle is directed at the officer or others. Officers should not shoot at any part of a vehicle in an attempt to disable the vehicle."

Imminent Threat Definition: A present and identifiable hazard with a high probability of causing damage.

Since he was also directly in front of the stopped vehicle, one would likely argue it was not feasible for him to take other reasonable steps to move out of the path.

Looks pretty open and shut to me. Going to be hard to nail him.

This seems like poor decisioning by the responding officers. There were there to assist in opening a car for someone else, Kroger employee says lady walking buy stole stuff, she obviously is going to try and flee, and the cop who shot went and stood in front of the car, not off to the side.

Without further evidence, this looks like a bad shot. And it pains me to say that.

I can't listen to the audio so don't know what was said. But driving your car into a cop who has his gun drawn seems really stupid and will generate the result seen in the video most of the time I would think.

I first thought it was a good shot, but then I started to think about being in that situation and I'm not so sure it was a good shot.

Let's assume you're an innocent person leaving a store, getting into your car and about to pull out of the parking spot, all the sudden a cop starts banging in your window.

I would be confused, flustered, is the car still in park or did I already put it in drive? What if while trying to stop or turn the car off you accidentally tap the gas pedal or bump the shifter?

Idk, being a cop is hard and I tend to side with them more often than not…

After reviewing the video several times, I would say the vehicle was moving at about 1MPH with the front wheels turning to the right as the officer at the front of the vehicle moved to the side, out of the vehicle's way, and discharged his firearm in the maneuver.

Yes, the cop was trying to prevent her from fleeing. How is that a poor decision? If he stands to the side she easily flees and now we've got a car chase or another thief that just gets away with it. Fleeing the cops by running into one with your car will get you shot.

"Are you going to shoot me" are some pretty dumb last words. Maybe don't try to drive past/over a cop with his gun drawn.

Having said that, that's a bad shoot unless the suspect was known and wanted for something pretty bad/imminently dangerous.

It was reported the baby died too.

I've never thought once in my life to intentionally not follow police orders to provide requested information or follow instructions given by the authorities.

She made a very poor choice in that situation.

Car was moving but the officer was already moving to the side of the car and she was turning away from him when he shot.

I get the "stopping her from fleeing" but if he need to do that then putting his body in front of the car was a really, really poor choice.

I support the police and they have an impossibly tough job, but this looks to me to be a poor approach.

Edited to add: Of course the lady made a stupid decision in the process of breaking the law after she had already broken other laws.

Yeah, in a bikini...but hunched over with clothes on? And I read elsewhere she was shoplifting alcohol.

I would be surprised if they could tell she was pregnant and not just thick.

I think it was faster than that. These things are happening fast and the adrenaline surge from thinking the car is going to be floored into you is probably real. These cops are humans who don't want to die or end up eating through a straw, same as you and me.

Trigger happy cop was already side-stepping out of the path of the car as he shot. He could have just not shot. The car had momentum anyway and would not have stopped regardless of him shooting.

The courts have ruled countless times that a vehicle is a deadly weapon and trying to run someone over with it, even if just starting to move, can be considered a lethal threat and met with a lethal response.

That said, the only reason this is getting any kind of attention outside the local area is because she was black. The media loves to try to stoke more anti-police and racism flames.

That image does not line up with what I witnessed in the video. He had already shot by that point.

I think we can all agree on one thing...I wish she has been white, so no one would care, it wouldn't be in the news, and we would all be able to agree that she acted stupidly and should not have tried to ram an officer with gun drawn with her vehicle.

The image is after he shot, but you can see him shifting to the side as he shoots in the video. Hard to capture that in a still image.

The lady was really dumb, but these cops were losing their minds over a suspected shoplifter it seems. Unless there is more to the story that made her an actual threat that hasn't come out yet.
