NEW ORLEANS, LA (May 23, 2023) Today, Firearms Policy Coalition (FPC) released a statement on the Fifth Circuit's Order granting an Injunction Pending Appeal in Mock v. Garland, FPC and FPC Action Foundation's federal lawsuit challenging the Bureau of Alcohol, Tobacco, Firearms and Explosives' (ATF's) recent rule reclassifying braced pistols as National Firearms Act (NFA)-regulated short-barreled rifles. The injunction, along with other case documents, can be viewed at FPCLaw.org.

Per the the Fifth Circuit's Order, "IT IS ORDERED that the appeal is EXPEDITED to the next available Oral Argument Calendar. IT IS FURTHER ORDERED that Appellants' Opposed Motion For a Preliminary Injunction Pending Appeal is GRANTED as to the Plaintiffs in this case."

So let me lay down an overview of this issue.

SBR's (short barrel rifles) are regulated under the NFA Act of 1934. This stupid piece of legislation required federal registration for short barrel rifles, shotguns, suppressors, and fully automatic weapons. For you libs, that means you hold the trigger down and in continues to PEW PEW PEW.

Towards the end of the Obama administration, the BATFE decided to decree that pistols with braces were legal and not subject to NFA. Stop there. This is mostly AR's and AK variants. Totallly legal for manufacturers to make and sell weapons that classify as pistols (per barrel length federal law) with stocks, as long as the stock is a "stabilizing brace". The feds did this. 100%.

Millions of Americans went out and bought millions of these products. Why? Because short barreled rifles are very convenient for many reasons. And, the kicker, they didn't have to go thru the massive headache of NFA registration, paperwork, forms, fees, wait times, etc.

Now, under president **** his pants authoritarian ass wipe dark Brandon, the BATFE and DOJ, have completely reversed their own ruling, thus turning millions of Americans in to felons overnight, effective 5/30/23, as I understand it.

I have a short barreled rifle with a pistol brace. A CMMG Banshee 22lr. It's a small gun and women and kids love to shoot it. It looks like a mini AR15 but with none of the kick or noise. The bullets are super inexpensive. I also put a binary trigger (squeeze -PEW, release - PEW) and a speed loader for the mags so you can unload a clip in no time. It's not full auto, but you get the feel of it. It's all my neighbor kid talks about when he sees me. I want to put a suppressor on it so you don't even need hearing protection.

Dumb thing is this is probably one of the last guns I would choose in any kind of real fire fight. It's a really dumb rule. ATF said this gun was legal for years, only to reverse it by unelected bureaucrat fiat. There are millions of pistol brace guns out there. I don't see how this is not entrapment. If they want to do this, it should be by OUR ELECTED OFFICIALS, who answer to us.

The NFA needs to be repealed.

I wish I still had mine to give up but they were lost when my boat sank after catching fire due to the volcanic eruption caused by the comet impact. I was hoping that the tsunami would carry the boat clear but the aftershocks of the induced earthquake nixed that bit of luck I was hoping for.
