Runkle's wrap up.

Trial is going to start early at 8:15 MT so the lawyers can argue about jury instructions because this judge uses MUJIs unless the parties want something different. So that's a mess created by the judge.

Not sure who will be streaming tomorrow tomorrow morning in a timely fashion.

Defense will officially rest. Plaintiff brings their rebuttal case. They start with Dr. Boehm. Live n person or via Zoom? No idea, If via Zoom, there will be long delays due to technical problems galore.

Then plaintiff's want to call Craig Ramon for the third time. He has largely sucked on cross each time he was on the stand before and I suspect that plaintiff's counsel is actively trying to hog defense counsel's time by that move. Judge told them that won't happen. Defense was not told how many witnesses plaintiff would call on rebuttal despite days of asking.

So Ramon being evasive and asking counsel to repeat the question four times will not work this time. (I think)

SNAFU and FUBAR as usual for this trial.

Dr. Boehm will be testifying for plaintiff over zoom as the first witness on rebuttal.

Defense won an important argument over spoiliation of evidence that goes to the go-pro video. Did it ever exist? And if the jury doesn't buy Shae's excuse that the run was so crowded that day someone would have filmed it and thus she made a huge assumption in her response to the "I.m famous" email.

Jury will hear that instruction.

As I expected, Dr. Boehm has connection problems on zoom and his testimony will now be over the phone. Awkward and the jury won't be able to follow most of it anyway. Waste of time

And after that disaster of testimony, Plaintiff's counsel decides not to call any further witnesses for rebuttal.

The evidentiary portion of the trial has concluded.

After much arguing over the final jury instructions, finally going to closing statements.

I have to say, watching his lawyer Robert Sykes speak knowing his client has a loser case is somewhat amusing. Sykes likes police misconduct cases in general. As I indicated previously, Sykes is the attorney for Gabby Petito's family in their civil suit against the city of Moab.

I was laughing at the automated milking machine is an example of executive function argument. On what planet would the other lawyers not tell him that was a poor analogy.

Or his own witnessing car accident story. Sykes talked about himself more than Terry. Buhler focused more on their client. Even if he did throw some shade on him as being a PITA to his lawyers, LOL.

Think it will be a fairly quick verdict. One juror, a lady, asked the judge if they needed to use their juror numbers or their names when signing the verdict form. Guessing she's already the foreperson.

In a break now but defense closing should be coming up next.

Haven't been impressed with Owens but he's not doing a bad job here.

Egan is now up to finish for the defense.

Sorenson is now delivering the rebuttal for the plaintiff. He is still maintaining that Sanderson was knocked unconscious. I really don't think there was enough evidence that that ever happened. Sanderson spent over two hours with ski patroller, Whitney, evaluating him the whole time. Never told her he was unconscious as she would have called an ambulance for him.

And we are done with closing.

Judge giving final instruction and selecting the alternative jurors.

We are on verdict watch.

Now the lawyer for the media companies want to be able to film the reactions when the verdict is announced.

I never thought I would be rooting for a movie star. This is a first.

They have reached a verdict. Will be ready soon. Law talk with Mike is streaming. Not sure about the others. He says he will cut over from his other stream to the court room when everyone is ready.

I think if they were really haggling over damages they wouldn't have taken this short of a time. No way Paltrow loses, right?

You missed a lot of crappy lawyering. The only bright spot was defense counsel, James Egan. He was pretty good.

Verdict:

Comparative fault: 100% Sanderson's fault.

$1 damages to Paltrow.

He was giving a presser after the verdict and lied again. Said he was once prescribed anti-anxiety medication in 1991 and never refilled it until just before this trial. Like any pharmacy would refill a prescription from 1991?

Sanderson claims GP said she "wished him well." And that he said, "Thank you, dear."

There is a bad faith argument to be made here.

Not a fan of Paltrow but came to this case neutral just like Depp v. Heard. Had no idea about either one of them but watched the trial. Depp is a POS but Amber Heard was an unbelievable and not credible POS. Advantage to Depp there.

Here, Sanderson's version just didn't make sense. Not the mechanisms of injury, the skis not being released, position of the bodies and with the involvement of a Deer Valley ski instructor of almost 40 years and ski patrollers for Deer Valley being closely involved from the first few seconds after. No corroborating evidence to support his version. Not even the medical evidence indicated a traumatic brain injury.
